Decision 2966/QD-BTNMT

1. What is the Department of Land?

According to Article 1 of Decision 2966/QD-BTNMT in 2022, the Land Department is an organization under the Ministry of Natural Resources and Environment, with the following functions:

- Advise and assist the Minister in formulating and guiding the implementation of land policies and laws; rights and obligations of land users;

- Assess the impact of land policies and laws;

- Monitor and evaluate land management and use; check the implementation of land policies and laws.

2. 16 tasks and powers of the Department of Land in Vietnam

The tasks and powers of the Department of Land in Vietnam are specified in Article 2 of Decision 2966/QD-BTNMT 2022, specifically as follows:

(1) Work on developing policies and laws on land, such as synthesizing and proposing programs to develop long-term, annual legal documents on land; Assess the impact of land policies and laws; Participate in developing legal documents related to the field of land as assigned by the Minister;...

(2) The work of reviewing, systematizing, and consolidating legal documents on land and the codification of the legal system on land; Check and process legal documents on land:

- Propose a plan to review and systematize legal documents on land; organize implementation after approval;

- Preside and coordinate with relevant units to develop land consolidation documents as assigned by the Minister;

- Preside and coordinate with relevant units to develop a Code of Conduct and legal system on land under the Ministry's state management scope;

- Preside over and coordinate to inspect and make recommendations to competent agencies to handle legal documents on land.

(3) Guidance on exercising the rights and responsibilities of the state; rights and obligations of land users according to land use regimes and when exercising their land use rights.

(4) Organize propaganda, dissemination, and education of land policies and laws as assigned by the Minister.

(5) Inspection of the implementation of land policies and laws, such as: proposing a plan to inspect the implementation of land policies and laws and organizing implementation after approval; Guide the implementation of land policies and laws nationwide according to the provisions of the law;...

(6) Organize the construction, management, and operation of the monitoring and evaluation system for land management and use; guide and inspect the management and operation of the monitoring and evaluation system for local land use and management.

(7) Carry out legal support activities for people and businesses in the land field as assigned by the Minister.

(8) Participate in legal opinions on the handling of issues in the land field as assigned by the Minister.

(9) Regarding international law and implementing land law policies with foreign elements such as: proposing content to legislate provisions of international treaties on land management in developing legal documents; preside over guiding and inspecting the implementation of land access rights, rights, and obligations of land users with respect to foreign organizations, individuals, and foreign-invested economic organizations as assigned by the Minister;...

(10) Advise on responding to voters' opinions, recommendations, and questions from National Assembly deputies regarding the land sector as assigned by the Minister.

(11) Coordinate with units under the Ministry to respond to organizations and individuals about land policies and laws as assigned by the Minister.

(12) Participate in scientific research, international cooperation programs, and projects as assigned by the Minister.

(13) Implement administrative reform according to the Ministry's administrative reform program and plan and the Minister's assignment; practice savings; and prevent and combat corruption and waste according to the provisions of law.

(14) Aggregate and reporting focal point in the field of land management; statistics; and periodic and extraordinary reports on the implementation of assigned tasks.

(15) Manage civil servants and assets under the Department according to regulations.

(16) Perform other tasks assigned by the Minister.

Decision 2966/QD-BTNMT takes effect on January 1, 2023.
