While practicing law, lawyers must be particularly mindful not to engage in prohibited lawyer conduct as stipulated in the Law on Lawyers 2006, amended in 2012.
10 acts that lawyers are strictly prohibited from performing in their practice are:
- Providing legal services to clients with opposing interests in the same criminal case, civil case, administrative case, civil matter, or other matters as stipulated by law;- Intentionally providing or guiding clients to provide false or fraudulent documents and evidence; instigating detainees, suspects, defendants, or litigants to give false testimonies or encouraging clients to file unlawful complaints, accusations, or lawsuits;- Disclosing information about a case or client known during the practice, except in cases where the client consents in writing or as otherwise stipulated by law;- Harassing or deceiving clients;- Accepting or demanding any additional money or benefits from clients beyond the agreed remuneration and expenses outlined in the legal service contract;- Colluding or having relationships with judicial officials, parties involved in the litigation, or other officials and public employees to act contrary to the law in resolving cases;- Abusing their legal practice or the title of a lawyer to negatively affect national security, public order, safety, or infringing upon the interests of the State, public interests, or the legitimate rights and interests of agencies, organizations, and individuals;- Accepting or demanding any money or benefits when providing legal aid to clients eligible for legal aid as stipulated by law; refusing cases already undertaken at the request of legal aid organizations or judicial authorities, except in cases of force majeure or as stipulated by law;- Using language or behavior that insults individuals, agencies, or organizations during litigation processes;- Personally or assisting clients in performing illegal acts to delay, prolong the time, or cause difficulties and obstacles to the activities of judicial agencies and other state agencies.
