On December 25, 2014, the Government of Vietnam issued Decree 122/2014/ND-CP on the organization and operation of Health Inspectorate.
09 Tasks and Powers of the Chief Inspector of the Department of Health of Vietnam (Illustrative image)
Decree 122/2014/ND-CP stipulates the Chief Inspector of the Department of Health of Vietnam to perform duties and powers as prescribed in Article 25 of the Law on Inspection, Article 14 of Decree 86/2011/ND-CP, and the following duties and powers:
- Decide to establish the Inspection Team according to the inspection plan approved by the Director of the Department of Health.
- Decide on unexpected inspections when signs of legal violations are detected or as required by the settlement of complaints, denunciations, and anti-corruption tasks assigned by the Director of the Department of Health.
- Submit to the Director of the Department of Health for decision to establish the Inspection Team, Interdisciplinary Inspection Team according to the approved inspection plan or as required.
- Assist the Director of the Department of Health in checking, verifying, concluding, and proposing solutions for resolving complaints under the authority of the Director of the Department of Health when assigned.
- Organize citizen receptions according to legal regulations; assist the Director of the Department of Health in monitoring, inspecting, and urging the bodies under the direct management of the Director of the Department of Health in citizen receptions and solving complaints, enforcing legal complaint resolutions.
- Verify denunciation contents, conclude the verification results, propose measures for handling denunciations under the authority of the Director of the Department of Health when assigned.
- Review and conclude on the settlement of denunciations that heads of the units under the direct management of the Director of the Department of Health have resolved but show signs of legal violations; if there are grounds to believe that their resolution of denunciations violates the law, propose the Director of the Department of Health to re-examine and resolve the matter.
- Request heads of specialized inspectorates to report on periodic or unexpected specialized inspection tasks.
- Other duties and powers as stipulated by law.
Additionally, the Decree also stipulates that the Inspectorate of the Department of Health of Vietnam performs duties and powers prescribed in Article 24 of the Law on Inspection, Article 13 of Decree 86/2011/ND-CP, and the following duties and powers:
- Develop the annual health inspection plan according to the guidance of the Ministry of Health for submission to the Director of the Department of Health for approval; orient the specialized inspectorates assigned the inspection function under the Department of Health to develop annual inspection plans.
- Receive citizens as prescribed by law.
- Summarize and report to the Director of the Department of Health, Chief Inspector of the Ministry of Health, Chief Inspector of the province on the results of inspection work; resolve complaints, denunciations; and anti-corruption within the management scope of the Department of Health as stipulated by law.
- Other duties and powers as stipulated by law.
