September 10, 2020, the Government of Vietnam issued Decree 106/2020/ND-CP on job positions and the number of employees in public service providers.

Article 14 of Decree 106/2020/ND-CP clearly stipulates 09 responsibilities and authorities of the People's Committees of provinces and centrally-run cities in determining job positions and the number of workers in public service providers, specifically:

1. Decide on the approval, adjustment of job positions, and structure of public employees according to professional titles of public service providers under the management scope as stipulated in Clause 3, Article 6 of this Decree.

2. Decentralize or authorize the management and use of job positions within public service providers under the management scope.

3. Organize the appraisal and compilation of the plan for the number of workers in public service providers under the management scope as regulated and submit it to the Ministry of Home Affairs for appraisal.

4. Submit to the People's Council at the same level for approval the total number of workers receiving salaries from the state budget in public service providers partially covering their own recurrent expenditures and public service providers fully funded by the state budget within the management scope within the total number of workers appraised by the Ministry of Home Affairs.

5. Decide on the allocation and adjustment of the number of workers receiving salaries from the state budget for each public service provider partially covering their own recurrent expenditures and public service providers fully funded by the state budget under the management scope within the total number of workers approved by the People's Council at the provincial level.

6. Decide on the allocation and adjustment of the number of workers receiving salaries from business revenues for public service providers partially covering their own recurrent expenditures according to regulations.

7. Guide, inspect, and supervise the compliance with legal regulations on the management and use of job positions, the number of workers in public service providers under the management scope.

8. Resolve complaints, denunciations, and handle violations regarding the management and use of job positions, the number of workers in public service providers under the management scope according to legal regulations.

9. Annually, compile and report on job positions, the structure of public employees according to professional titles, and the number of workers in public service providers under the management scope of the previous adjacent year according to Appendix III and Appendix IV, and submit to the Ministry of Home Affairs before January 31 for compilation and reporting to the Government of Vietnam, the Prime Minister of the Government of Vietnam.
