09 Mandatory Disclosures Required for Awareness of Officials and Public Employees

This is a notable regulation mentioned in Decree 04/2015/ND-CP regarding the implementation of democracy in the activities of state administrative agencies and public service providers.

Pursuant to Article 7 of Decree 04/2015/ND-CP, nine matters are mandated to be publicly disclosed for officials and public employees, specifically listed below:

- Policies and guidelines of the Communist Party and State laws related to the work of the agency or unit.

- Annual, quarterly, and monthly work plans of the agency or unit.

- Annual operating expenses, including budget allocations from the state and other financial sources; annual financial settlements of the agency or unit; assets and equipment of the agency or unit; audit results.

- Recruitment, training, fostering, transfer, appointment, rotation, secondment, resignation, dismissal; working contracts, changes in job titles, changes in job positions, termination of working contracts of public employees; overseas business trips, policy resolutions, salary promotions, rank promotions, assessments, classifications of officials and public employees; rewards, disciplines, resignations, retirements of officials and public employees; proposals, projects, and drafting of legal documents by the agency or unit.

- Concluded negative and corrupt activities in the agency or unit; asset and income declarations of those obligated to declare according to the law.

- Results of inspections, examinations, complaint, and denunciation resolutions within the agency or unit.

- Internal regulations and rules of the agency or unit.

- Results of feedback collection from officials and public employees on issues within the decision-making authority of the head of the agency or unit, as stipulated in Article 9 of this Decree.

- Directives and operational documents from superior management agencies relating to the work of the agency or unit.

This Decree stipulates that agencies and units must apply one or a combination of the following forms of public disclosure:

a) Posting at the agency or unit;

b) Announcing at conferences for officials and public employees of the agency or unit;

c) Sending written notices to all officials and public employees;

d) Notifying the heads of the agency's or unit's departments and requiring them to inform the officials and public employees working in those departments;

e) Sending written notices to the direct Party committee, the Executive Committee of the Trade Union of the agency or unit;

f) Posting on the internal information page of the agency or unit.

The disclosure deadline is no later than three working days, or in special cases, no more than five days from the date the document is issued or received from a superior agency or unit, excluding confidential documents as prescribed by law. Documents posted at the agency's or unit's headquarters must be continuously posted for at least 30 days from the posting date.
