09 areas, routes, locations that are prohibited from conduct trade activities by individuals in Vietnam

Recently, the Government of Vietnam has issued Decree 39/2007/ND-CP regarding individuals conducting commercial activities independently and regularly without having to register for business in Vietnam.

Article 6 of Decree 39/2007/ND-CP stipulates that, unless otherwise provided by law, individuals are strictly prohibited from engaging in commercial activities in the following areas, routes, and locations in Vietnam:

  1. Areas belonging to historical or cultural sites that have been classified, and other scenic locations;
  2. Areas around government agencies, diplomatic missions, and international organizations;
  3. Areas within the safety perimeter of ammunition depots, explosive material warehouses, ammunition manufacturing plants, and the camps of the Vietnam People's Army;
  4. Areas in and around airports, seaports, international border gates, railway stations, harbors, bus stations, ferry terminals, and on transportation vehicles;
  5. Areas around schools, hospitals, religious institutions, and places of worship;
  6. Parking and stopping areas for traffic vehicles on the road and waterways;
  7. Road areas, including entrances and exits of residential complexes or collective zones; alleys; sidewalks, roadbeds, and pavement of urban roads, district roads, provincial roads, and highways allocated for pedestrians and vehicles. Exceptions are areas, routes, or portions of sidewalks designated or temporarily permitted by competent authorities for commercial activities;
  8. Routes, areas (including tourism areas) designated by the People's Committee of the province/city under central authority (referred to as provincial People's Committee) or an authorized agency. Such locations must have signs prohibiting individuals from engaging in commercial activities;
  9. Areas under the use rights of organizations or individuals, even if not prohibited from being used as business locations under points a to h of this clause, yet not consented by the respective organization or individual, or areas with signs prohibiting individual commercial activities.

Details can be found in Decree 39/2007/ND-CP, which comes into effect in Vietnam from September 14, 2007.
