On January 10, 2011, the Inspectorate of the Government of Vietnam issued Circular 05/2011/TT-TTCP Regulations on anti-corruption in the inspection sector.
08 Prohibited acts in anti-corruption inspection in Vietnam (Illustrative image)
Article 8 of Circular 05/2011/TT-TTCP stipulates 08 prohibited acts in inspection in Vietnam, including:
Taking advantage of one’s position to interfere in the construction of inspection plans, conducting inspections, supervising, urging the implementation of recommendations, and making decisions post-inspection for personal gain.
Exploiting assigned duties to add unnecessary inspection contents or omit necessary inspection contents from the inspection scope.
Issuing inspection decisions beyond authority, inspecting beyond the scope and content stated in the inspection decision.
Exploiting the name of the agency, the head of the agency, or the unit to resolve personal matters during the inspection process.
Abusing inspection position and power to commit illegal acts or harass inspected entities, units, or related individuals.
Falsifying case files during the inspection process, making false reports, false conclusions, or illegal handling decisions, shielding those with legal violations.
Disclosing or providing information and documents about an inspection plan before approval, or inspection conclusions before they are signed and approved by the competent authority.
Other acts prohibited in inspection activities as stipulated by law in Vietnam.
Note: Inspectors assigned the responsibility of anti-corruption inspections in Vietnam shall not carry out any acts as mentioned above.
