08 matters regarding training and retraining of Vietnamese public employees to be inspected

This is an important content in Circular 09/2012/TT-BNV issued on December 10, 2012 by the Ministry of Home Affairs on the procedures and matters regarding the recruitment, employment, and management of Vietnamese officials and public employees to be inspected.

08 matters regarding training and retraining of Vietnamese public employees to be inspected (Illustrative image)

Article 39 of Circular 09/2012/TT-BNV prescribes 08 matters regarding the training and retraining of Vietnamese public employees to be inspected as follows:

  1. The formulation, approval, and implementation of the training and retraining plans for Vietnamese public employees of the inspected subjects.
  2. The authority to approve the training and retraining plans for Vietnamese public employees; the authority to sign decisions to send Vietnamese public employees for training and retraining.
  3. The compliance with standards and conditions of those being sent for training and retraining.
  4. The implementation of mandatory annual programs for updating knowledge and professional skills for Vietnamese public employees.
  5. The implementation of policies towards Vietnamese public employees during training and retraining periods; job assignment during and after the training periods.
  6. The use of funds for training and retraining Vietnamese public employees.
  7. The compensation for training and retraining costs for Vietnamese public employees (if any).
  8. Other matters prescribed in Section 3, Chapter III of Decree 29/2012/ND-CP dated April 12, 2012, of the Government of Vietnam and other legal provisions on training and retraining Vietnamese public employees.

Additionally, the matters regarding policies on salary and other remuneration for Vietnamese public employees to be inspected are specified as follows:

- The salary payment mechanism for Vietnamese public employees of the inspected subjects.

- The grading of salaries and regular salary step upgrade for Vietnamese public employees.

- Salary step upgrade ahead of schedule and exceptional salary step upgrade for Vietnamese public employees who have merits, achievements, and contributions in professional work, including:

+ Conditions and standards for Vietnamese public employees eligible for salary step upgrade ahead of schedule and exceptional salary step upgrade.

+The percentage ratio of Vietnamese public employees receiving salary step upgrade ahead of schedule and exceptional salary step upgrade compared to the total number of Vietnamese public employees in the inspected subjects.

+ The process of consideration and decision-making for salary step upgrade ahead of schedule and exceptional salary step upgrade.

- The consideration of allowances and preferential policies for Vietnamese public employees working in mountainous areas, border areas, islands, remote areas, ethnic minority areas, particularly disadvantaged areas, or working in hazardous, dangerous environments, and special professional fields.

- Other remuneration policies for Vietnamese public employees as prescribed by law or issued by inspected subjects.

- Other matters prescribed in Decree 204/2004/ND-CP dated December 14, 2004, of the Government of Vietnam and its guiding documents; Decree 76/2009/ND-CP dated September 15, 2009, of the Government of Vietnam and its guiding documents; Article 16 of Decree 90/2012/ND-CP dated November 05, 2012, of the Government of Vietnam and other legal provisions on salary policy for Vietnamese public employees.
