Regarding this issue, LawNet answers as follows:

On December 31, 2023, the Government issued Decree 98/2023/ND-CP detailing the implementation of a number of articles of the Law on Emulation and Commendation 2022.

Specifically, the principles for considering emulation titles and commendation forms from 2024 in Vietnam specified in Article 4 of Decree 98/2023/ND-CP are as follows:

(1) Rewards must be based on conditions, standards, and achievements; it is not necessary to have a low-level reward to receive a higher-level reward.

(2) Competent authorities reward or request superiors to reward emulation titles and forms of reward for cases that meet the conditions, standards, procedures, and documents according to regulations.

(3) Results of commendation for extraordinary achievements and emulation by subject are not used as a basis for requesting superiors to reward merit.

(4) Having not been rewarded or requested superiors to reward individuals or groups while the competent authority is considering disciplinary action, investigation, inspection, or examination when there are signs of violations, complaints, denunciations, corruption, or negative issues reported by the press that are being verified and clarified.

In the event that an individual or group is disciplined after completing the disciplinary period and achieves achievements, the reward achievement will be calculated from the time of completing the disciplinary period.

(5) The maternity leave period for individuals, according to regulations, is calculated to consider awarding emulation titles and forms of reward.

(6) When there are many individuals or groups that meet the same conditions and standards, select a female individual or a group with a female ratio of 70% or more to be considered for reward.

(7) The time spent holding a position to consider and reward contributions for individuals who are female leaders and managers is reduced by 1/3 of the time compared to general regulations. If a female leader or manager is subject to a higher retirement age, the time to consider and reward her contributions will comply with general regulations.

Responsibilities of agencies, organizations, and units in emulation and commendation work in Vietnam

Responsibilities of agencies, organizations, and units in emulation and commendation work include:

- Heads of agencies, organizations, and units shall directly lead, direct, and take responsibility for the result of emulation and commendation work; detect individuals, collectives, and households with achievements to commend based on entitlements or as requested by superior agencies; expand the typical advanced model; assess achievements; take responsibility for issuing commendation decisions and presenting such decisions to superior agencies.

- Agencies, organizations, and units shall apply information technology and modernization of management to emulation and commendation work.

- The Vietnam Fatherland Front and its member organizations shall, within their scope of tasks and entitlements, implement regulations prescribed in Clause 1 and Clause 2 of Article 13 of the Law on Emulation and Commendation 2022 and shall:

+ Disseminate, mobilize, and encourage union members, members, and the People to comply with laws on emulation and commendation;

+ Organize or cooperate with agencies, organizations, and units in organizing emulation movements;

+ Supervise the implementation of policies and laws on emulation and commendation and social criticism regarding drafts of policies and laws on emulation and commendation.

- Press agencies shall implement regulations prescribed in Clause 1 and Clause 2 of Article 13 of the Law on Emulation and Commendation 2022 and regularly disseminate guidelines of the CPV, policies and laws of the State on emulation and commendation; actively participate in detecting individuals, collectives, and households with excellent achievements; disseminate and popularize goods examples, good people, and good deeds, contributing to the encouragement of emulation movements. The dissemination work must reflect the correct result of emulation movements and commendation and timely reflect and fight against violations of laws on emulation and commendation.

- Agencies, organizations, and units that provide advisory services and assistance regarding emulation and commendation work shall:

+ Provide advisory services and propose the implementation of emulation and commendation work;

+ Provide advisory services for the launch emulation movements; develop programs, plans, and contents of emulation;

+ Guide, urge, and inspect the implementation of emulation and commendation work; receive, consider, and appraise applications for emulation titles and commendation forms; present such applications to competent authorities for consideration of issuance of commendation decisions;

+ Provide advisory services regarding the preliminary and summary of emulation movements.
