On May 14, 2018, the Ministry of Transport issued Circular 26/2018/TT-BGTVT stipulating the conditions, sequences, and procedures for implementing the rail connection of urban railways and specialized railways with the national railway; and the rail connection of urban railway lines.
The connection of railway lines must adhere to the following 07 principles:
The connection and the location of the connection of railway lines must be consistent with the railway planning and socio-economic development planning of the locality where the connection position is located, as approved by the competent authority.
The exploitation of the railway lines after the connection must ensure efficiency, create more development motivation compared to before the connection; ensure synchronization, safety, national defense, security, fire and explosion prevention, rescue and salvage, urban landscape, and environmental protection.
The connection of railway lines must not affect the operation, exploitation, and traffic safety of related railway lines.
The operation of transportation on the railway line after the connection must comply with the provisions of the Railway Law and be implemented as follows:- The enterprise managing the national railway infrastructure will take the lead, coordinate and agree with the owner of the dedicated railway or the enterprise managing the urban railway when connecting with the national railway;- The enterprise managing the urban railway on the connected urban railway line will take the lead, coordinate, and agree with the enterprise managing the urban railway on the urban railway line with connection needs.
The project dossier for the construction investment of the railway line connection must comply with the provisions of construction investment law and must be approved by the Ministry of Transport for connection with the national railway or by the Provincial People's Committee for connection with the urban railway.
In case of the need to connect urban railway lines to share infrastructure or temporarily connect to serve rescue and salvage work, the Provincial People's Committee decides on a case-by-case basis.
In cases where urban railway lines are implemented by a single investor with a plan for continuous train operation, synchronized technical design, and technology, conforming to the connection policy approved by the chairman of the Provincial People's Committee, a connection permit is exempted.
