Recently, the Ministry of National Defense of Vietnam has issued Circular 79/2013/TT-BQP stipulating the functions, duties, powers, organizational structure, and working relationships of the legal sections and legal officers in the Army.
07 Duties and powers in legal support for enterprises in Vietnam (Illustrative image)
Circular 79/2013/TT-BQP stipulates 7 tasks and powers of legal sections and legal officers in the Military in providing legal support for enterprises in Vietnam as follows:
1. Lead, cooperate with relevant agencies and units to develop annual programs and plans for legal support for enterprises within the scope of the sector and field of management and organize implementation.
2. Lead, cooperate with relevant agencies and units to propose legal support activities for enterprises in the sector and field under the Ministry's management, submit to the Minister for consideration, and send to the Ministry of Justice for consolidation into the inter-sectoral legal support program.
3. Receive and respond to legal queries from enterprises under the management of the Ministry, sector, or localities in cases where the responses from specialized agencies of the Ministry, sector, or localities do not meet the enterprises' requirements.
4. Receive, compile, and report to the Minister for consideration, decision, or recommendation to competent authorities to consider amending, supplementing, or issuing new legal documents related to the sector and field under the Ministry's management as proposed by enterprises, and send to the Ministry of Justice for consolidation.
5. Lead, coordinate in building and posting on the electronic information page about the legal database related to the activities of enterprises within the sector and field of management of the Ministry of National Defense of Vietnam.
6. Lead, cooperate with relevant agencies and units to compile documents introducing and disseminating laws related to the activities of enterprises under the management of the Ministry of National Defense.
7. Annually or unexpectedly, develop a report of the Ministry of National Defense of Vietnam on the implementation of legal support activities for enterprises and send it to the Ministry of Justice for consolidation.
