07 disciplinary measures against Vietnamese officials and public employees who commit violations against regulations on thrift and wastefulness prevention

Recently, the Government of Vietnam issued Decree 103/2007/ND-CP stipulating the responsibilities of heads of agencies, organizations, units and the responsibilities of Vietnamese officials and public employees in thrift and wastefulness prevention.

Article 21 of Decree 103/2007/ND-CP prescribes 07 disciplinary measures against Vietnamese officials and public employees who commit violations against regulations on thrift and wastefulness prevention as follows:

1. The reprimand applies to individuals who commit violations for the first time and have to compensate for damages up to 5,000,000 VND per compensation review.

2. The warning applies to individuals who have already been disciplined with a reprimand but reoffend, or first-time violators who cause waste and must compensate for damages ranging from over 5,000,000 VND to 20,000,000 VND per compensation review.

3. The salary step downgrade applies to individuals who have already been disciplined with a warning but re-offend, or first-time violators who cause waste and must compensate for damages ranging from over 20,000,000 VND to 30,000,000 VND per compensation review.

4. The grade downgrade applies to individuals who have already been disciplined with a salary step downgrade but re-offend or first-time violators who cause waste and must compensate for damages ranging from over 30,000,000 VND to under 50,000,000 VND per compensation review.

5. The dismissal applies to individuals holding positions who have already been disciplined with grade downgrade but re-offend.

6. The removal from office applies to individuals who have already been disciplined with one of the forms of salary step downgrade or grade downgrade but re-offend, causing significant consequences and are deemed no longer fit to continue working or first-time violators who cause waste and must compensate for damages from 50,000,000 VND or more per compensation review.

7. Heads of agencies, organizations, and units assigned to manage state capital and assets who violate the law on thrift and wastefulness prevention are disciplined similarly to Vietnamese officials and public employees.
