07 Cases of Dismissal of Representatives of Enterprises Holding Over 50% of Capital Under the Ministry of National Defense

This is the notable content stipulated in Circular 178/2019/TT-BQP issued by the Ministry of National Defense. It prescribes standards and conditions for the appointment, reappointment, dismissal, resignation, transfer, and rotation of managerial positions at enterprises that are single-member limited liability companies with 100% charter capital held by the State under the management of the Ministry of National Defense; standards and conditions for the assignment, re-assignment, and dismissal of Representatives of state capital portions holding managerial positions at enterprises where the State holds more than 50% charter capital and is owned by the Ministry of National Defense.

To be specific, according to Article 16 Circular 178/2019/TT-BQP, it is stipulated that state capital representatives holding management positions in enterprises where the State holds more than 50% of charter capital, under the ownership of the Ministry of National Defense, shall be dismissed under one of the following circumstances:

- Submits a request to resign before the term and is approved by the competent authority;- Transfers to another position as decided by the competent authority;- Reaches retirement age;- The Ministry of National Defense divests all capital from the enterprise;- In two consecutive years of the term as a representative, is assessed and classified at a level of not completing tasks;- Violates ethical standards or the regulations on actions party members are prohibited from doing, for representatives who are party members;- Other cases of dismissal as prescribed by law.

Regarding the procedures for dismissing a Representative: Follow the regulations on personnel work and other relevant regulations of the Ministry of National Defense.

Note, representatives after dismissal will be considered for a new position or resolve policies as prescribed by law.
