On June 10, 2023, the Government of Vietnam issued Decree 33/2023/ND-CP on commune-level cadres and civil servants and part-time workers at commune level, in villages and residential quarters, including regulations on salaries and allowances for commune-level cadres and civil servants from August 1, 2023.

1. 07 benefits regarding salary and allowance for commune-level cadres and civil servants from August 1, 2023 in Vietnam

07 benefits regarding salary and allowance for commune-level cadres and civil servants from August 1, 2023, according to Section 4 Chapter II of Decree 33/2023/ND-CP, as follows:

(1) Salary arrangement for commune-level cadres and civil servants:

- Commune-level cadres and civil servants graduated from training according to the standards of professional qualifications specified in Decree 33/2023/ND-CP, and their salaries are arranged like administrative civil servants with the same training level as specified in the professional salary table for cadres and civil servants in state agencies promulgated together with the Government's Decree on the salary benefits for cadres, civil servants, public employees, and the armed forces.

The graduation diploma at the training level shall comply with the regulations of the Ministry of Education and Training and of the agency or organization competent to grant the degree.

- In case, during the working period, commune-level cadres and civil servants have changes in their training qualifications suitable to their current positions and titles, then request the district-level People's Committee chairperson to arrange salary according to the new training level from the date of granting the diploma.

- In case the person elected as a commune-level cadre, is recruited and accepted as a commune-level civil servant according to the provisions of Decree 33/2023/ND-CP, if they have worked for a period of time with compulsory social insurance payment and have not received a lump-sum social insurance allowance, then:

Working time with compulsory social insurance payment is calculated as a basis for salary arrangement (except for probationary period), and working time with intermittent compulsory social insurance payment shall be accumulated. .

(2) Increase in the salary level for commune-level cadres and civil servants:

Commune-level cadres and civil servants specified in Clause 1, Article 16 of Decree 33/2023/ND-CP shall implement the regular salary increase benefits, raise the salary level ahead of time, and extend the time for raising the salary grade according to the Government's regulations on the salary benefits for cadres, civil servants, public employees, and the armed forces.

(3) Overtime allowance:

Commune-level cadres and civil servants specified in Clause 1, Article 16 of Decree 33/2023/ND-CP are entitled to the overtime allowance benefits according to the Government's regulations on the salary benefits for cadres, civil servants, public employees, and the armed forces.

(4) Commune-level leadership allowance for commune-level officials

Commune-level cadres specified in Clause 1, Article 16 of Decree 33/2023/ND-CP are entitled to a leadership position allowance compared to the base salary as follows:

- Secretary of the Party Committee: 0.30.

- Deputy Secretary of the Party Committee, Chairman of the People's Council, Chairman of the People's Committee: 0.25.

- Chairman of the Fatherland Front Committee, Vice Chairman of the People's Council, Vice Chairman of the People's Committee: 0.20.

- Secretary of Ho Chi Minh Communist Youth Union, President of Women's Union, President of Farmers' Union, President of Veterans Association: 0.15.

* Specifically, applying the new base salary according to Decree 24/2023/ND-CP, the seniority allowances for commune-level cadres and civil servants are as follows:

- Secretary of the Party Committee: 540,000 VND;

- Deputy Secretary of the Party Committee, Chairman of the People's Council, Chairman of the People's Committee: 450,000 VND;

- Chairman of the Fatherland Front Committee, Vice Chairman of the People's Council, Vice Chairman of the People's Committee: 360,000 VND;

- Secretary of Ho Chi Minh Communist Youth Union, President of Women's Union, President of Farmers' Union, President of Veterans Association: 270,000 VND.

(5) Allowances concurrently holding positions and titles:

- Commune-level cadres and civil servants who concurrently hold positions and titles of commune-level cadres and civil servants different from their current positions and titles, but reduce by 01 person out of the number of commune-level cadres and civil servants assigned by the district-level People's Committees according to the provisions of Clause 5, Article 6 of Decree 33/2023/ND-CP, then:

From the date the competent authority decides the part-time job, they are entitled to a part-time allowance equal to 50% of the salary (level 1), plus the allowance for the leadership position (if any) of the part-time position or title; allowances for concurrent positions and titles are not used to calculate the payment and enjoyment of social insurance and health insurance benefitss.

In cases where concurrently holding multiple positions and titles (including the case where the Secretary of the Party Committee is concurrently the Chairman of the People's Committee, the Secretary of the Party Committee is concurrently the Chairman of the People's Council) is only entitled to the highest part-time allowance, the district-level People's Committees shall decide on positions and titles entitled to part-time allowances. In cases where the number of positions arranged concurrently is larger than the number of commune-level cadres and civil servants, it can be reduced compared with the regulations.

- In cases where commune-level cadres and civil servants concurrently perform the tasks of part-timers at the commune, village or residential level, they are entitled to a part-time allowance equal to 100% of the prescribed allowance of the part-time position.

(6) Social insurance and health insurance benefits:

The social insurance and health insurance benefitss applied to commune-level cadres and civil servants comply with the law on social insurance and health insurance.

(7) Training and retraining benefits:

The training and retraining benefits for commune-level cadres and civil servants shall comply with the Government's regulations on training and fostering cadres, civil servants, and public employees and the regulations of the Party and socio-political organizations at the central level.

2. General standards for commune-level cadres and civil servants in Vietnam

General standards for commune-level cadres and civil servants in Vietnam according to Article 7 of Decree 33/2023/ND-CP are as follows:

- General standards for commune-level cadres and civil servants comply with current regulations of the law on cadres and civil servants, organizational charters, and regulations of the Party and central socio-political organizations.

- Civil servants who are Commanders of the Commune-level Military Command, in addition to the standards specified in Clause 1, Article 7 of Decree 33/2023/ND-CP, must also be able to coordinate with units of the People's Army, People's Public Security, and other forces in the locality to participate in building the all-people national defense and perform civil defense tasks; to maintain security, politics, social order, and safety, to protect the Party, government, and property of the State and to protect the people's lives and property.
