From November 20, 2024, there will be 06 Types of foreign-invested educational institutions according to the latest regulations in Vietnam.

On October 5, 2024, the Government of Vietnam issued Decree 124/2024/ND-CP amending and supplementing a number of articles of Decree 86/2018/ND-CP on foreign cooperation and investment in education in Vietnam.

06 types of foreign-invested educational institutions in Vietnam from November 20, 2024

From November 20, 2024, there will be 06 types of foreign-invested educational institutions in Vietnam, including:

(1) Short-term training and nurturing institutions.

(2) Preschool educational institutions.

(3) General education institutions (elementary schools, middle schools, high schools, multi-level schools).

(4) Higher education institutions.

(5) Branches of foreign-invested higher education institutions in Vietnam.

(6) Branches of foreign higher education institutions in Vietnam.

(Article 28 of Decree 86/2018/ND-CP, supplemented by Decree 124/2024/ND-CP)

Rights and obligations of foreign-invested educational institutions in Vietnam from November 20, 2024

Article 28 of Decree 86/2018/ND-CP (supplemented by Decree 124/2024/ND-CP) prescribes the rights and obligations of foreign-invested educational institutions in Vietnam as follows:

- They are protected regarding legal rights and interests per Vietnamese law and international agreements that Vietnam is a part of.

- Subject to administrative management by the provincial People's Committee; they operate and are subject to state management according to Vietnamese law.

- Transparently commit to educational quality, conditions ensuring educational quality, and financial revenues and expenditures. They are responsible for reimbursing learners for costs incurred if the training program does not meet the educational quality as committed.

- Ensure the legal rights and interests of learners, staff, lecturers, teachers, and employees in case of premature termination of operations.

- Facilitate the activities of political organizations or social-political organizations established and operated under Vietnamese law within foreign-invested educational establishments.

- By November 30 each year, report to the direct state management agency the comprehensive development status of the institution and provide full explanations when required by the management agency. Reports include core content: the implementation of operational permits, organizational structure, teachers and lecturers, enrollment numbers, teaching and learning organization work, academic results, graduates, graduation rates, degrees issued, financial reports, and challenges and advantages during implementation, proposals, and recommendations. Reports must be submitted online and in writing.

- Other rights and obligations by Vietnamese law.

- In the case where a foreign university establishes several branches in various provinces and cities of Vietnam, each branch must be established, operate, and exercise rights and obligations in accordance with Decree 86/2018/ND-CP and Decree 124/2024/ND-CP; relationships between branches are determined and regulated in the organizational and operational regulations of each branch.

- Branches of foreign universities in Vietnam are only allowed to issue diplomas or certificates from the foreign universities that invested in establishing the branch.

More details can be found in Decree 124/2024/ND-CP, which comes into force in Vietnam from November 20, 2024.
