Regarding this issue, LawNet would like to answer as follows:
On October 26, 2023, the Prime Minister issued Decision 1251/QD-TTg approving the Program to strengthen the capacity to prevent and respond to national environmental incidents until 2030 (hereinafter referred to as the Program) .
06 tasks in the Program to strengthen capacity to prevent and respond to environmental incidents at the national level until 2030
Specifically, the tasks in the Program to strengthen capacity to prevent and respond to national environmental incidents by 2030 include:
(1) Complete policies and laws on preventing and responding to environmental incidents at the national level
- Research to amend and supplement functions and tasks to respond to national environmental incidents for the forces of ministries, branches and localities in the national environmental incident response system.
- Research and improve regimes and policies for forces performing functions and tasks of responding to national-level environmental incidents.
- Research to amend, supplement, and complete regulations on mechanisms for mobilizing, using resources, and financial management in implementing national-level environmental incident response.
(2) Complete the system of organizing forces to respond to environmental incidents at the national level:
- Arrange and consolidate the organizational system of national environmental incident response forces based on the forces of the Ministry of Defense and ministries, branches, and localities to ensure good implementation of the following tasks: monitoring; evacuating people and property; providing initial medical assistance; responding to and overcoming consequences; ensuring security and order; The National Action Center to Remediate the Consequences of Chemical Toxics and the Environment (NACCET) is the core force to ensure timely, effective, and efficient operations.
- Organize and use national-level environmental incident prevention and response forces to ensure effectiveness; warn, respond promptly, flexibly, clearly understand responsibilities, mobilize, synchronously coordinate, and unify forces when incidents occur according to the process prescribed by the Ministry of National Defense, which must ensure the principles:
+ The locality where the incident occurs must immediately report to the competent authority for assessment, decentralization, and incident response, and at the same time notify NACCET to be ready to respond to national-level environmental incidents.
+ The Ministry of National Defense is the agency in charge and organizes responses to environmental incidents at the national level, mobilizing forces from ministries, branches, and localities to participate; Direct core forces to establish a field command post to organize and coordinate forces participating in responding to national-level environmental incidents.
(3) Improve monitoring and warning capacity of monitoring stations to serve national-level environmental incident response
- Upgrade existing environmental monitoring stations of the Ministry of National Defense, the Ministry of Natural Resources and Environment, and the Ministry of Science and Technology.
- Research and forecast national-level environmental incidents.
- Build and update the database on national environmental incident risks nationwide; and the environmental status database from the monitoring station system of the Ministry of National Defense, the Ministry of Natural Resources and Environment, and the Ministry of Science and Technology.
(4) Enhance national-level environmental incident response capacity
- Develop a set of scenarios, response procedures, and guidance documents for responding to national environmental incidents as a basis for command, administration, and coordination between ministries, branches, and localities.
- Equip vehicles, equipment, and facilities to ensure national environmental incident response forces of ministries, branches, and localities, in particular, focus on strengthening the organization and investing in equipment for core forces participating in responding to national-level environmental incidents. Build a database to manage forces and means to respond to national environmental incidents.
- Organize training, education, and improve qualifications for forces participating in responding to national-level environmental incidents. Organize national-level environmental incident response drills (every 5 years or unexpectedly).
- Ensure national reserves of essential goods and equipment to respond to environmental incidents.
(5) Raise awareness about preventing and responding to environmental incidents at the national level
- Promote propaganda and dissemination of laws to raise awareness of the risks and harmful effects of national-level environmental incidents; on the roles and responsibilities of organizations and individuals in environmental protection activities in general, and in the prevention and response of national-level environmental incidents in particular.
- Strengthen management, inspection, and handling of violations against establishments at risk of causing environmental pollution according to the provisions of law.
(6) Strengthen international cooperation in research and the organization of responses to national-level environmental incidents
- Develop bilateral and multilateral cooperation programs with relevant countries and international organizations on environmental incident response. Prepare plans and be ready to send forces and vehicles to participate in training, exercises, and responses to environmental incidents in the region and internationally.
- Enhance the exchange of information and data on the risks of environmental incidents; cooperate in research, application, and technology transfer to serve environmental incident response.
Decision 1251/QD-TTg takes effect from the date of signing.
