06 non-commercial documents to be licensed for publication in Vietnam

Recently, the Government of Vietnam issued Decree No. 195/2013/NĐ-CP detailing a number of articles of, and measures for implementing, the Publication Law.

According to Article 12 of Decree No. 195/2013/NĐ-CP of Vietnam’s Government, 06 non-commercial documents to be licensed for publication include:

1. Public information documents serving political tasks, major anniversaries and important events of the country;

2. Documents guiding the study and implementation of the Party’s lines and policies and the State’s laws;

3. Documents guiding measures for natural disaster and epidemic prevention and control and environmental protection;

4. Records of conferences and seminars and development records of Vietnamese agencies and organizations;

5. Brochures on operations of foreign agencies and organizations lawfully operating in Vietnam;

6. Documents on the history of the Party and local administrations; documents serving political tasks of localities, with opinions of superior-level Party organizations or agencies.

The competence to license publication of non-commercial documents is as follows:

- The Ministry of Information and Communications shall issue publishing license of non-commercial materials of agencies and organizations in the central and foreign organizations;

- Provincial-level People's Committee shall issue publishing licenses of non-commercial materials of the other agencies and organizations with legal status, branches, representative offices at localities of the central agencies and organizations.

- For documents of units under the people’s army or people’s police, state management agencies of publication activities shall grant publication permits after obtaining opinions of the Ministry of National Defense or the Ministry of Public Security or agencies authorized by the Ministry of National Defense or the Ministry of Public Security.

Note: The Minister of Information and Communications shall specify the dossier and procedures for applying for publication permits for non-commercial documents prescribed above.
