On November 9, 2024, the Government of Vietnam promulgated Decree 147/2024/ND-CP managing, supplying, and using Internet services and online information.
According to Clause 16, Article 9 of Decree 147/2024/ND-CP, domain names will be revocated in the following cases:
(1) Execution of a domain name revocation request as per decisions, judgments, resolutions on domain name disputes by competent agencies or organizations, or in a mediation agreement as per legal regulations on mediation;
(2) Execution of decisions by the Minister of Information and Communications in regards to domain name revocation for national interests, public interests, socio-economic development, national defense, security, or if no longer conforming to Internet resource planning as stipulated in the Telecom Law;
(3) Execution of administrative penalty decisions by competent authorities handling violations in Information and Communications or other specialized inspections with measures to recover domain names or apply supplementary penalties like confiscating offending materials, means;
(4) Execution of requests in writing by investigative agencies or competent state bodies as prescribed in point a, clause 13, Article 9 of Decree 147/2024/ND-CP to promptly prevent acts of domain name use infringing on national security, public order, and social safety;
(5) Applicable to Vietnam national domain name ".vn" for failure to pay sufficient fees for maintaining the use of this domain name within 30 days from the due date;
(6) Cases where registration information for domain name use is inaccurate, the entity cannot be identified, or the entity does not update, supplement, or complete the information; the registered domain name is non-compliant with management concerning structure, registration subject; the domain holder is an organization, enterprise that has dissolved, bankrupt, ceased to exist without a lawful transfer of use rights to another entity as per legal regulations; or individuals who have passed away without a lawful transfer of use rights to another entity as per legal regulations.
Clause 7, Article 9 of Decree 147/2024/ND-CP stipulates the information required when registering domain names from December 25, 2024, as follows:
- For agencies, organizations, enterprises: Name of the agency, organization, enterprise; electronic identity of the organization; business registration number; tax identification number; full address of the head office; phone number; email address; information of the domain manager; information of the domain technical manager; information of the organization or individual paying registration and usage fees for the domain; purpose of the domain name use in the case of registering for setting up a general electronic information site, social network, electronic newspaper, and updating the purpose of domain name use when changes occur;
- For individuals, business households: Full name of the individual; name of the business household, full name of the head of the household or the household representative; date of birth; personal identification number or ID card number or passport number and place of issue, date of issue; business household registration number; business household tax identification number; full permanent address up to the house number; full temporary address up to the house number; phone number; email address.
