Below are the requirements for the establishment and management of the Database on Residence in Vietnam from January 10, 2025, as stipulated in Decree 154/2024/ND-CP.

On November 26, 2024, the Government of Vietnam issued Decree 154/2024/ND-CP guiding the Law on Residency 2020.

Pursuant to the provisions of Article 12 in Decree 154/2024/ND-CP, the requirements for establishment and management of the Database on Residence in Vietnam include:

- The Database on Residence is centrally and uniformly built and managed at the identity management agency of the Ministry of Public Security.

- The Database on Residence is developed according to information technology standards and technical regulations, economic-technical norms, ensuring connectivity with the National Population Database and related national and specialized databases, operating stably and continuously.

- Ensure information security, safety, protection of personal data, facilitating the collection, updating, adjustment, exploitation, and usage.

- Ensure the right to access information for agencies, organizations, and individuals as prescribed by law.

- Ensure complete, accurate, and prompt collection, updating, and adjustment of information; fully store citizens' information during each collection, update, and adjustment in the database.

Information in the citizens' Database on Residence in Vietnam from January 10, 2025

The information in the citizens' Database on Residence is stipulated in Article 11 of Decree 154/2024/ND-CP includes:

- Residency record number.

- Information specified in clauses 1 to 15, clauses 21 to 25, Article 9, and clause 4, Article 15 of the Law on Identity 2023.

- Other names.

- Permanent residence, starting time at permanent residence; reason and time for revoking permanent residence registration.

- Temporary residence, starting time, and duration of temporary residence; reason and time for revoking temporary residence registration.

- Temporary absence declaration status, subject of temporary absence declaration, duration, destination during the temporary absence, end time of absence.

- Current residence, starting time at current residence.

- Place of lodging, duration of lodging.

- Criminal record.

- Administrative violation record.

- Applied preventive measures.

- Criminal record expungement.

- Number, name of the agency, authorized person, date, month, year of issuance of documents for acquiring Vietnamese nationality, renunciation of Vietnamese nationality, revocation of Vietnamese nationality, annulment of Vietnamese nationality acquisition decision.

- Number, date, month, year, issuing agency of warrant, search, or warrant recall decisions.

- Other information about citizens integrated and shared from other databases.

Principles of residency and residency management in Vietnam

According to Article 3 of the Law on Residency 2020, the principles of residency and residency management are stipulated as follows:

- Compliance with the Constitution 2013 and the law.

- Ensuring the harmony of the rights and legitimate interests of citizens, the State, the community, and society; combining the assurance of the right to freedom of residence, and other fundamental rights of citizens with the responsibility of the State in economic-social development, national defense consolidation, ensuring social order and safety.

- Procedures for residency registration must be simple, convenient, prompt, accurate, public, transparent, and not cumbersome; residency management must be carried out strictly and effectively.

- Information on residency must be updated into the National Population Database and the Database on Residence as prescribed by law; at any given time, each citizen has only one permanent residence and may additionally have one temporary residence.

- All acts violating the law on residency registration and management must be promptly and strictly detected and handled in accordance with the law.

Refer to Decree 154/2024/ND-CP effective from January 10, 2025.

Decree 62/2021/ND-CP, detailing certain provisions of the Law on Residency 2020, ceases to be effective from the date Decree 154/2024/ND-CP takes effect.
