Regarding this issue, LawNet would like to answer as follows:

On May 25, 2023, the Ministry of Industry and Trade of Vietnam issued Decision 1239/QD-BCT promulgating the Code of Conduct for cadres, civil servants, public employees, and employees of the Ministry of Industry and Trade.

According to Clause 2, Article 4 of the Regulation promulgated together with Decision 1239/QD-BCT, prohibited acts of cadres, civil servants, public employees, and employees include:

(1) Abuse of positions and powers of individuals, in the name of agencies or units currently working to handle and settle private matters; using property, equipment, and public means for improper purposes or for personal purposes in any form.

(2) Having a bureaucratic, authoritarian, bossy, corrupt, or abusive attitude or behavior; suggesting to give money, receive money, accept gifts, or accept work done outside the agency, outside working hours, for personal gain; indifference, insensitivity, or irresponsibility to the difficulties and problems of organizations and citizens.

(3) Losing, damaging, or falsifying records and documents related to requests of organizations and citizens when assigned the task of settling; must comply with the discipline of speaking, not arbitrarily speaking, and providing documents and documents related to the activities of agencies, units, ministries, and branches to organizations and individuals without the consent of the competent authority;

Using social networks to exploit and propagate unverified, one-sided information affecting public service activities; propagating and promoting depraved images, documents, and acts of superstition in the workplace.

(4) Revealing state secrets, work secrets, secret contents, and the full name of the person who wrote the complaint or denunciation letter in accordance with the law.

(5) Other jobs as prescribed by the law on cadres, civil servants, public employees, and employees; the law on anti-corruption, thrift practice, anti-waste, and other relevant laws.

The behavior of officials, civil servants, and public employees holding leadership and management positions of the Ministry of Industry and Trade, the conduct of cadres, civil servants, and public employees holding leadership and management positions of the Ministry of Industry and Trade must comply with the following contents:

- Upholding the responsibility of leading by example; enthusiasm, dedication, and exemplary leadership in all aspects. Not taking advantage of your position to appoint acquaintances; take the initiative to resign from his position when he realizes that he has limited capacity and low prestige.

- Maintaining internal unity; implementing grassroots democracy; respecting, listening to, and absorbing the correct opinions of subordinates; acting according to the principles of democracy, objectivity, fairness, and transparency; not being self-willed, forceful, or conservative; not punishing or taking advantage of comments and criticism to damage the reputation of subordinates.

- Assigning tasks to subordinates clearly and regularly checking and monitoring the implementation; capturing the thoughts and aspirations of cadres, civil servants, public employees, and employees to arrange and use them to promote the experience, capacity, and forte of each individual.

- Fairness and objectivity in the use and evaluation of cadres, civil servants, public employees, and employees under their management; protecting the honor of cadres, civil servants, public employees, and employees when there are untrue reflections and denunciations.

- Building the working environment of agencies and units
