05 Prohibited Acts in the state secret protection in the Culture, Sports, and Tourism Sector in Vietnam

On September 29, 2014, the Ministry of Culture, Sports, and Tourism issued Circular 09/2014/TT-BVHTTDL regulating the protection of state secrets in the fields of culture, sports, and tourism in Vietnam.

05 Prohibited Acts in the state secret protection in the Culture, Sports, and Tourism Sector in Vietnam (Internet image)

Circular 09/2014/TT-BVHTTDL stipulates 05 prohibited acts in the state secret protection in the fields of culture, sports, and tourism in Vietnam as follows:

  1. Collecting, providing, revealing, losing, appropriating, buying, and destroying unauthorized documents or materials containing state secrets in the fields of culture, sports, and tourism.

  2. Exchanging or providing information, documents, and materials containing state secrets to agencies, units, or individuals without approval from the competent authority.

  3. Connecting internal computer networks to the Internet, exchanging, and storing information, documents, and materials containing state secrets on computers connected to the Internet.

  4. Using mobile phones and devices with recording or signal transmission features in meetings with state secret content.

  5. Exchanging information containing state secrets via walkie-talkies, mobile phones, cordless phones, and fax machines without permission from the competent authority.

Additionally, this Circular stipulates the authority in the state secret protection work in the fields of culture, sports, and tourism, specifically:

- Authority to print, copy, photograph, and destroy documents or materials containing state secrets; provide information, documents, and materials containing state secrets to agencies, units, and Vietnamese citizens:

-  State  secrets  classified  as  "Top  Secret"  and  "Secret"  are  approved  by  the  Minister  of  Culture,  Sports,  and  Tourism;

-  State  secrets  classified  as  "Confidential"  are  authorized  by  the  Minister  of  Culture,  Sports,  and  Tourism  to  the  heads  of  affiliated  units  and  the  Directors  of  the  Departments  of  Culture,  Sports,  and  Tourism;

-  The  persons  authorized  in  point  b  cannot  delegate  their  authority  to  others.

- Authority to provide information, documents, and materials containing state secrets to foreign agencies, organizations, and individuals:

-  State  secrets  classified  as  "Top  Secret"  are  approved  by  the  Prime  Minister  of  the  Government  of  Vietnam;

-  State  secrets  classified  as  "Secret"  are  approved  by  the  Minister  of  Public  Security;

-  State  secrets  classified  as  "Confidential"  are  approved  by  the  Minister  of  Culture,  Sports,  and  Tourism.

Details can be found in Circular 09/2014/TT-BVHTTDL, which comes into effect in Vietnam from November 14, 2014.
