On December 27, 2024, the Government of Vietnam promulgated Decree 169/2024/ND-CP providing guidance on the organization and operations of the People's Committees of wards of Hanoi.
Decree 169/2024/ND-CP provides detailed regulations on the organization and operations of the People's Committees of wards of Hanoi (hereinafter referred to as the city).
Article 4 of Decree 169/2024/ND-CP stipulates 05 operational principles of the People's Committees of wards of Hanoi from January 1, 2025 as follows:
(1) The People's Committees of wards work based on the principle of centralized democracy. The Chairman of the People's Committees of wards decides on matters within the duties and powers of the People's Committees of wards and the Chairman of the People's Committees of wards, and is responsible for their decisions.
(2) In case of a vacancy in the position of Chairman of the People's Committees of wards, the Chairman of the District, District-level Town, or City People's Committee within the city decides to delegate the duties of the Chairman of the People's Committees of wards until a new appointment is made.
(3) Specific duties and powers of the People's Committees of wards and those decentralized and authorized as prescribed in Clause 1, Article 13 and Article 14 of the Capital Law 2024 must be collectively discussed before the Chairman of the People's Committees of wards makes a decision and bears responsibility for it.
The collective as defined in Clause 3, Article 4 of Decree 169/2024/ND-CP includes the Chairman of the People's Committees of wards, Vice Chairman of the People's Committees of wards, and other relevant officials.
(4) The activities of the People's Committees of wards must satisfy the people's expectations, comply with procedures, and adhere to the delegated authority as per the law, the Working Regulation of the People's Committees of wards. Enhance administrative reform, apply online public services in resolving administrative procedures for individuals and organizations at the ward in accordance with the law, ensuring that the operations of the People's Committees of wards are democratic, public, transparent, unified, efficient, and effective.
(5) The Ward Police Chief advises and is subject to the direction of the Chairman of the People's Committees of wards in performing duties related to security, order, social safety, fighting against crime, and other law violations in the area according to legal regulations.
- Accountable to the Chairman of the People's Committees of wards, Vice Chairman responsible, and before the law in performing tasks as assigned by the Chairman of the People's Committees of wards and tasks authorized as per the law.
- Proactively advise, propose solutions to assigned tasks in compliance with time, result, and authority; serve the people devotedly, not cause difficulties or inconveniences to the people. For issues beyond authority, report to the Chairman of the People's Committees of wards or the responsible Vice Chairman for consideration and decision.
- Comply with the working regulations of the People's Committees of wards, strictly adhere to the task assignments by the Chairman of the People's Committees of wards; resolve work according to the assigned responsibilities and duties, ensuring progress and work quality.
- Fulfill the obligations of an official and adhere to regulations on prohibited activities for officials as prescribed in the Law on Cadres, Officials, and other relevant legal regulations.
- Other officials of the People's Committees of wards violating the responsibilities stated in Article 7 of Decree 169/2024/ND-CP will be subject to consideration and handling according to the Law on Cadres, Officials, and relevant legal provisions.
