Regarding this issue, LawNet would like to answer as follows:

On September 5, 2023, the Minister of Home Affairs issued Circular 14/2023/TT-BNV promulgating Regulations on updating, exploiting, and managing specialized databases of Home Affairs.

05 principles of updating, connecting, exploiting, and managing specialized databases of Home Affairs in Vietnam

Updating, connecting, exploiting, and managing the specialized database of Home Affairs must comply with the principles specified in Article 4 of the Regulations issued with Circular 14/2023/TT-BNV as follows:

(1) The specialized database of Home Affairs is centrally managed from central to ministries, branches, and localities; ensure consistency in direction and administration; maximize resource concentration; and shorten time spent collecting, editing, and updating information for the specialized Home Affairs database in agencies and units.

(2) Updating and managing the specialized Home Affairs database is the responsibility of relevant agencies and units, implemented consistently, continuously, synchronously, scientifically, fully, accurately and promptly reflecting information in the fields under the state management function of the Ministry of Home Affairs.

Updating the database ensures the principle that data is only collected from one source, once without duplication, and is shared with relevant information systems for data mining.

(3) The specialized database of Home Affairs is shared to serve the activities of state agencies towards serving people and businesses in compliance with the law in creating, managing, and using data.

(4) Agencies and units that are allowed to connect, share, and exploit information with the specialized database of Home Affairs must ensure information system infrastructure conditions, connection model, data structure, security, safety, and information security according to the provisions of law.

(5) The specialized database of Home Affairs is stored, kept confidential, and ensures information security. The construction, management, exploitation, and use of specialized Home Affairs databases must comply with the Vietnam e-Government architecture and the e-Government architecture of the Ministry of Home Affairs, regulations on the management, connection, and sharing of digital data by state agencies, and other relevant laws.

The specialized database of Home Affairs is a collection of digitized data and information specialized in Home Affairs developed, managed, and assigned to specialized database management agencies at ministerial, branch, provinces/cities directly under the central government manage, use, and delegate power to agencies and units under the management of ministries, branches, and localities.

Regulations on exploitation and use of information in the specialized database of Home Affairs in Vietnam

Specifically, Article 9 of the Regulations issued together with Circular 14/2023/TT-BNV regulates the exploitation and use of information in the specialized database of Home Affairs as follows:

- Information in the specialized Home Affairs database is used uniformly nationwide and has legal value in the management of the Home Affairs sector.

- The form of exploitation and use of information in the specialized database of Home Affairs is done through the granted account or through the data integration and sharing platform.

- The use of information in the specialized database of Home Affairs must comply with the provisions of law on data ownership and personal information security protection.

- Management agencies and subordinate agencies and units are allowed to exploit and use information within the scope of management; promulgate internal regulations on data management, use, and exploitation, which specifically stipulate responsibilities for managing and exploiting and using information from user accounts; Receive and process comments and complaints regarding data within management authority.

- Agencies, organizations and individuals outside the Home Affairs sector that need to use information from the specialized Home Affairs database must comply with the law on access to information.

- For information related to the Ministry of Public Security and the Ministry of National Defense, updating, exploiting and using information must ensure regulations on security and national defense information security according to the provisions of law.

Circular 14/2023/TT-BNV takes effect from October 16, 2023.
