05 Principles for Applying Land Use Standards

Circular 01/2017/TT-BTNMT was issued by the Ministry of Natural Resources and Environment, stipulating the norms for land use in the construction of cultural facilities, medical facilities, educational and training institutions, and sports facilities. This is the first Circular to provide detailed regulations on this matter.

When applying land use standards, the following principles must be adhered to:

- Land use standards for construction specify the minimum and maximum land area for a specific type of project corresponding to each administrative level; in case there is a project of a higher level authority on that administrative level, the land type corresponding to that project is added with the land area of the project of the higher authority.- Land use standards per capita specify the minimum and maximum land area for one person for each specific area and corresponding to each administrative level; in case there is a project of a higher level authority on that administrative level, the land type corresponding to that project is added with the land area of the project of the higher authority.- Depending on the conditions of each locality, one or several constructions can be built, but the total area of each type of construction in the area must not exceed the maximum area determined according to the population scale of the locality.- In case an administrative unit has a low population scale and the total area of a type of land calculated per capita of that administrative unit is too small, it is permissible to apply the construction land area equal to the minimum land area of the land use standard per construction.- During the implementation process, if there are difficulties or obstacles, agencies, organizations, and individuals promptly report them to the Ministry of Natural Resources and Environment for consideration and resolution.
