05 policies for individuals post-rehabilitation at the center in Vietnam

On October 26, 2009, the Government of Vietnam promulgated Decree 94/2009/ND-CP providing guidance on the amended Law on Drug Prevention and Control regarding post-rehabilitation management in Vietnam.

Decree 94/2009/ND-CP stipulates 05 policies for post-rehabilitation individuals at centers, including: Management policies, vocational training policies, labor and labor achievement policies, contribution and allowance policies, Health Insurance, and funeral leave policies in Vietnam, as follows:

Management Regime

- Post-rehabilitation individuals are allowed to bring essential personal items; meet with relatives, send letters or communicate with family; receive money, blankets, clothing, medicines, food, and other essential personal items sent by relatives as regulated by the Center; participate in cultural, sports, and entertainment activities and other collective activities organized by the Center.

- During the stay at the Center, post-rehabilitation individuals must comply with the regulations and rules of the Center regarding management, education, learning, living, labor, and training; must participate in production labor to self-finance food and living expenses.

Vocational Training Regime: Post-rehabilitation individuals can receive vocational training and skill enhancement based on the conditions and organizational capabilities of the Center.

Labor and Labor Achievement Regime

- Post-rehabilitation individuals must adhere to the Center's policies, and working hours and are equipped with labor protection equipment, ensuring labor safety and hygiene as regulated.

- Post-rehabilitation individuals receive wages based on labor norms and completed work results or according to a labor contract. Labor wages are used for living expenses, and the remaining amount is saved. Upon completion of the decision, they receive the saved money and corresponding interest.

- In case of a work-related accident, the Center must promptly organize medical treatment and complete necessary procedures to resolve allowance policies as prescribed by law.

Contribution, Allowance, Health Insurance Regime

- Post-rehabilitation individuals at the Center must contribute food expenses, medical examination and treatment fees, and other management costs as regulated. Those from poor households, families with policies under the Ordinance on Privileges for Persons with Meritorious Services to the Revolution, minors, individuals with end-stage AIDS, and homeless individuals are considered for exemptions or reductions in contributions.

- Post-rehabilitation individuals at the Center receive state support for a portion of food expenses, medicine fees, vocational training fees, personal necessity purchases, and other costs during the decision compliance period.

- Post-rehabilitation individuals at the Center are covered by health insurance according to current regulations on health insurance benefits.

Funeral Leave Policy: In cases where the parents, grandparents (both paternal and maternal), spouse, children, siblings of the post-rehabilitation individual pass away, upon the family's request and confirmation from the commune-level People's Committee, the Center’s Director may allow the individual to return home for a funeral leave not exceeding three days (excluding travel time). The family is responsible for escorting the individual back to the Center. This period is counted in the decision compliance period.
