Regarding this issue, LawNet would like to answer as follows:

On August 31, 2023, the Prime Minister of Vietnam issued Decision 1012/QD-TTg on the Plan to Implement the Law on Protection of Consumers’ Rights.

Implementation contents of the Law on Consumer Rights Protection 2023 in Vietnam

Specifically, the Law on Protection of Consumers’ Rights 2023 will be implemented through the following contents:

(1) Organize conferences to thoroughly understand, disseminate, and provide in-depth training on the Law on Protection of Consumers’ Rights.

- Develop and compile documents to disseminate, propagate, and provide in-depth training on the contents of the Law on Protection of Consumers’ Rights for relevant agencies and organizations to refer to and use consistently nationwide; Organize conferences to thoroughly grasp, disseminate, and provide in-depth training on the Law on Protection of Consumers’ Rights and legal documents detailing this Law and relevant legal documents for officials and civil servants working in advisory and state management on protecting consumer rights at central agencies and People's Committees of provinces and centrally run cities.

- Organize conferences to thoroughly grasp, disseminate, and provide in-depth training on the Law on Protection of Consumers’ Rights, legal documents detailing this Law, and related legal documents for officials and civil servants of departments and branches at the provincial, district, and commune levels, people working part-time in the locality, local businesses, and consumers.

(2) Propagate and disseminate the Law on Protection of Consumers’ Rights.

Organize propaganda and dissemination of the content of the Law on Protection of Consumers’ Rights and new points of this Law in diverse forms, suitable to actual conditions and situations; Organize and implement columns, programs, news, and articles to disseminate the Law on Protection of Consumers’ Rights and legal documents detailing this Law and relevant legal documents in the mass media or other forms according to the provisions of law on dissemination and legal education.

(3) Organize the review of legal documents, directive documents, and guidance of ministries, branches, and localities on the protection of consumer rights.

Ministries, branches, and People's Committees at all levels, within the scope of their functions, tasks, powers, and fields of management, organize the review of relevant current legal documents; Directives and guiding documents on protecting consumer rights issued and implemented by ministries, branches, and localities; Propose amendments, supplements, replacements, annulments, or promulgations of new legal documents, relevant directives, and guidance documents, ensuring consistency between the provisions of specialized laws and documents of the People's Councils and People's Committees at all levels and the provisions of the Law on Protection of Consumers’ Rights.

Besides, the Ministry of Industry and Trade presides over and coordinates with the Ministry of Justice and relevant agencies to synthesize review results and recommendations of ministries, ministerial-level agencies, and People's Committees of provinces and centrally run cities to submit to the Government and Prime Minister for consideration of amending, supplementing, or promulgating new relevant legal documents.

(4) Develop and promulgate legal documents detailing and guiding the implementation of the Law on Protection of Consumers’ Rights

- Developing Government Decrees:

+ Government Decree detailing a number of articles and measures to implement the Law on Protection of Consumers’ Rights.

+ Government Decree amending and supplementing a number of articles of Decree 98/2020/ND-CP and Decree 17/2022/ND-CP.

- Developing the Prime Minister's Decision: Prime Minister's Decision promulgating the List of products, goods and services requiring contract registration according to the form and general transaction conditions (pursuant to Clause 1, Article 28 of the Law on Protection of Consumers’ Rights).

(5) Develop and implement national-level projects, schemes, programs, and activities on protecting consumer rights; promulgate regulations on the coordination of state management on protecting consumer rights.

Based on reviewing and summarizing the implementation of Decision 1157/QD-TTg in 2021, organize the development, promulgation, or submission to competent authorities for promulgation and implementation of national-level projects, schemes, programs, and activities on protecting consumer rights; promote sustainable production and consumption towards a green and circular economy; encourage and promote investment, production, distribution, export, and import of environmentally friendly products and technologies; and responsible business practices for consumers according to the provisions of Clause 1, Article 75 of the Law on Protection of Consumers’ Rights.

Ministries and ministerial-level agencies in their assigned management fields and People's Committees of provinces and centrally-run cities shall, according to their local authority, organize the implementation of regulations in Clause 1, Article 75 of the Law on Protection of Consumers’ Rights; coordinate with the Ministry of Industry and Trade to develop and promulgate documents and coordination mechanisms and implement state management on protecting consumer rights.

- Develop and promulgate regulations on the coordination of state management in protecting consumer rights in localities

Provincial People's Committees and District People's Committees are responsible for developing and promptly promulgating regulations on coordinated state management of protecting consumer rights between relevant state agencies in their localities according to the provisions of Point b, Clause 1, and Point g, Clause 2, Article 77 of the Law on Protection of Consumers’ Rights to ensure the synchronous, unified, and effective implementation of this Law locally.
