05 cases of reassignment of property at the Communist Party of Vietnam's agencies

This is a notable content of Decree 165/2017/ND-CP on the regulations for the management and use of property at the Communist Party of Vietnam's agencies.

Assets  at  Communist  Party  agencies  are  transferred,  according  to  Decree  165/2017/ND-CP

Article 25 of Decree 165/2017/ND-CP stipulates that property at the Communist Party of Vietnam's agencies can be reassigned in the following cases:

- There are changes in management agencies, organizational structure, or management decentralization;

- Property is reassigned from surplus to shortage places following the standards and property usage norms stipulated by the competent authority;

- Property reassignment brings higher usage efficiency;

- Communist Party of Vietnam's agencies are assigned to manage and use property but not in regular need;

- Other cases as stipulated by law.

Additionally, the power to decide on the reassignment of property at the Communist Party of Vietnam's agencies is stipulated as follows:

- The Chief of the Office of the Central Committee of the Communist Party of Vietnam decides or delegates power to decide on the reassignment of property among the Communist Party of Vietnam's central-level agencies and units at the proposal of the originating and receiving agencies and units; decides on the reassignment of property from Communist Party of Vietnam's central-level agencies and units to Communist Party of Vietnam's local-level agencies and units and vice versa based on the proposal of Communist Party of Vietnam's central-level agencies and units and the relevant standing committee of the provincial CPV committee; decides on the reassignment of property from one Communist Party of Vietnam's local-level agency to another at the proposal from the relevant standing committee of the provincial CPV committee (in the case where the Communist Party of Vietnam's local-level agency is a budget unit under the office of the provincial CPV committee);

- The standing committee of the provincial CPV committee decides or delegates power to decide on the reassignment of property among Communist Party of Vietnam's local-level agencies and units that are budget units under the office of the provincial CPV committee; reassignment of property from Communist Party of Vietnam's local-level agencies and units that are budget units under the office of the provincial CPV committee to office of the district-level CPV committee that are budget units under the district-level state budget at the proposal from the originating agency, unit, and the relevant standing committee of the district-level CPV committee;

- The standing committee of the district-level CPV committee decides on the reassignment of property from Communist Party of Vietnam's local-level agencies and units that are budget units under the district-level state budget to Communist Party of Vietnam's local-level agencies and units that are budget units under the office of the provincial CPV committee at the proposal from the originating agency and unit, the receiving agency and unit, and the opinion of the relevant District People's Committee;

- The power to decide on the reassignment of property in cases not specified in points a, b, and c of this clause shall follow the law applicable to state agencies.
