Recently, the Ministry of Home Affairs issued Circular 03/2006/TT-BNV providing guidance on the implementation of Decree 35/2005/ND-CP on the disciplinary actions against officials in Vietnam.
05 Cases of imposing the disciplinary form of reprimand on officials in Vietnam (Illustrative image)
To be specific, Circular 03/2006/TT-BNV stipulates 05 Cases of imposing the disciplinary form of reprimand on officials in Vietnam as follows:
- Officials who commit violations mentioned in Article 21 of Decree 35/2005/ND-CP, including cases where officials do not comply with the mobilization, assignment of tasks by competent authorities; officials who form factions, cause division affecting the completion of tasks of the agencies, organizations, units; officials who violate discipline, arbitrarily leave their work 2 times (with a total of no more than 6 days); violate ethical qualities while performing tasks or public service; violations for the first time of the regulations on what officials are prohibited from doing under the Ordinance on Officials but have realized their mistakes, do not cause serious consequences, and have a remedial direction;
- Officials who violate the provision and use of illegal diplomas and certificates to prepare records for examination, recruitment, studying to improve cultural, theoretical, and professional levels, or to take promotion exams; to meet the standards for appointment to leadership positions;
- Officials tasked with managing records, issuing diplomas, and certificates who fail in their responsibilities, falsify records to issue diplomas and certificates to ineligible individuals; or those assigned the authority to verify records but confirm them inaccurately compared to the original documents of the records on diplomas and certificates;
- Officials who have been disciplined with a reprimand for issuing or using illegal diplomas and certificates but now repeat the offense;
- Officials who use illegal diplomas and certificates to meet the conditions for training (intermediate, college, university, master's, doctorate) at educational institutions in Vietnam.
