05 Cases of dissolution of pedagogical colleges in Vietnam from November 20, 2024

On October 5, 2024, the Government of Vietnam issued Decree 125/2024/ND-CP stipulating conditions for investment and operation in the field of education. Decree 125/2024/ND-CP applies to: preschool educational institutions; independent nursery groups, independent kindergartens, independent preschools; general educational institutions; continuous education institutions; centers supporting inclusive education development; specialized schools; colleges providing vocational education for the group of teacher training at the college level; higher educational institutions; educational quality accreditation organizations; overseas study consulting service businesses; other organizations and individuals conducting educational activities.

As per Clause 1, Article 93 of Decree 125/2024/ND-CP, the 05 cases of dissolution of pedagogical colleges in Vietnam include:

- Serious violations of the regulations on management, organization, and operation of the school;

- Expiration of the suspension period as stated in the decision to suspend vocational education activities for the group of teacher training at the college level without rectifying the reasons leading to the suspension;

- The objectives and operational content in the decision on establishment or permission for establishment of the school no longer align with the socio-economic development needs;

- Failure to ensure educational quality;

- Failure to obtain a certificate of registration for vocational education activities for the group of teacher training at the college level after a period of 3 years from the effective date of the decision on establishment or permission for establishment;

- At the request of the organization or individual requesting the establishment or permission for establishment of the pedagogical college.

Procedures for dissolution of pedagogical colleges in Vietnam

According to Article 93 of Decree 125/2024/ND-CP, regarding authority, the Minister of Education and Training of Vietnam decides on the dissolution of pedagogical colleges.

Regarding dossier components:

- For the dissolution of a pedagogical college not based on the request of an organization or individual who requested the establishment or permission for the establishment, the dossier includes:

+ A report accompanied by evidence of the school's violations.

+ A plan for addressing issues related to organizational structure, personnel, finance, assets, land, and other relevant matters.

- For the dissolution of a pedagogical college based on the request of an organization or individual who requested the establishment or permission for the establishment, the dossier includes:

+ A proposal for the dissolution of the pedagogical college (according to Form No. 08 Appendix II attached to Decree 125/2024/ND-CP).

+ A scheme for dissolving the pedagogical college (according to Form No. 09 Appendix II attached to Decree 125/2024/ND-CP).

Regarding implementation sequence:

- For the dissolution of a pedagogical college not based on the request of an organization or individual who requested the establishment or permission for the establishment:

+ The Ministry of Education and Training organizes an inspection of the actual state of the school, draws up a record and notifies the school of any violations.

+ Within 20 days from the date of obtaining the inspection results, the Minister of Education and Training decides on the dissolution of the pedagogical college.

- For the dissolution of a pedagogical college based on the request of an organization or individual who requested the establishment or permission for the establishment:

+ The organization or individual submits one dossier via the online public service portal or by post or directly to the Ministry of Education and Training.

+ Within 20 days from the date of receiving the dissolution proposal dossier, the Minister of Education and Training decides on the dissolution of the pedagogical college.

- The decision to dissolve the pedagogical college (according to Form No. 10 Appendix II attached to Decree 125/2024/ND-CP) is publicly announced through mass media.
