04 principles for formulating contractor selection plans under CPTPP Agreement in Vietnam (Illustration)

Decree 95/2020/ND-CP stipulates 04 principles for formulating contractor selection plans for procurement bidding under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership as follows:

1. The contractor selection plan is formulated for the entire project, procurement estimate. In cases where conditions are insufficient to formulate the contractor selection plan for the entire project or procurement estimate, a contractor selection plan for one or several packages may be prepared for implementation first.

2. The contractor selection plan must clearly state the number of packages and the contents of each package as prescribed in Article 29 of this Decree.

3. The subdivision of the project or procurement estimate into packages must be based on technical characteristics and the implementation sequence; ensuring the project's, procurement estimate's uniformity, and reasonable package scale.

4. Packages must not be fragmented to avoid the application of this Decree.

Additionally, the Decree stipulates that before formulating the contractor selection plan to organize contractor selection, the procurement agency may conduct market consultation to prepare the contractor selection plan and develop bidding documents and requirements documents. In cases where contractor selection is needed to conduct market study packages under the CPTPP Agreement's scope, the contractor selection must comply with the regulations of this Decree.

The procurement agency may use the consultancy opinions of independent experts, competent agencies, or market enterprises in formulating the contractor selection plan but must ensure principles of competition, fairness, and transparency.
