04 notes when performing officials rotation in Vietnam from December 01, 2020

Specifically, according to the Decree No. 138/2020/NĐ-CP of Vietnam’s Government, some notes when performing officials rotation are as follows:

1. Dossiers of officials on rotation

According to Article 60 of the Decree No. 138/2020/NĐ-CP of Vietnam’s Government, the dossiers of rotating officials shall comply with the provisions for appointment dossiers specified in Article 48 of Decree No. 138/2020/NĐ-CP.

2. Time for rotation of officials

According to Article 61 of the Decree No. 138/2020/NĐ-CP of Vietnam’s Government, the rotation period is at least 3 years (36 months) for each time of rotation. Special cases shall be considered and decided by competent authorities.

3. Comments and evaluations for rotating officials

According to Article 62 of the Decree No. 138/2020/NĐ-CP of Vietnam’s Government, every 6 months, annually or at the request of competent authorities, committees, party organizations, leadership collectives, heads of agencies and organizations shall comment and evaluate rotated officials; report to the competent authority as prescribed. At the end of the rotation period:

- The rotating official shall self-review his/her work process during the rotation period;

- The collective leadership and committees of agencies and organizations comment and evaluate civil servants rotated during their work in the locality, agency or organization;

- Competent authorities decide the rotation shall comment and assess.

4. Arrangement of officials after rotation

According to Article 63 of the Decree No. 138/2020/NĐ-CP of Vietnam’s Government, the consideration of arrangement and assignment of officials after rotation must be based on task requirements, actual situation, and results of performing political tasks of localities, agencies and organizations associated with the individual responsibility of the official rotated and the results of staff comments and evaluation.
