The Government issued Resolution 170/NQ-CP in 2022 on the Plan to collect people's opinions on the draft Land Law (amended)

1. 04 forms of collecting people's opinions on the draft Land Law (amended) in Vietnam

- Direct written comments (paper, email) apply to all subjects seeking comments. Comments should be sent to agencies and organizations assigned responsibilities in Section III of this Plan or sent directly to the Ministry of Natural Resources and Environment at the address: No. 10 Ton That Thuyet, My Dinh 2 Ward, Nam Tu Liem District, Hanoi City or via email: luatdatdaiamonre.gov.vn

- Organize conferences, seminars, and workshops for state agencies, political organizations, socio-political organizations, socio-political-professional organizations, social organizations, socio-professional organizations, businesses, cooperatives, and other economic organizations; experts and scientists. Comments at conferences, seminars, and discussions are gathered and summarized by the agency hosting the conference, seminar, or discussion and sent to the agencies responsible for collecting people's opinions stated in Article 6 of Resolution 671/UBTVQH15 to prepare a report summarizing opinions to send to the Ministry of Natural Resources and Environment, and, at the same time, send it to the National Assembly's Economic Committee.

- Provide comments directly through the official website collecting people's opinions on the draft Land Law (amended) at website address: luatdatdai.monre.gov.vn

- Through the National Assembly's Electronic Information Portal, the Government's Electronic Information Portal, the Ministry of Natural Resources and Environment's Electronic Information Portal, mass media, forms of information technology application, and other forms in accordance with the provisions of law.

2. Subjects seeking comments on the draft Land Law (amended) in Vietnam

Subjects seeking comments on the draft Land Law (amended) include:

- People from all walks of life in the country and Vietnamese people residing abroad;

- State agencies at central and local levels; Vietnam Fatherland Front Committees at all levels; and the Front's member socio-political organizations, socio-political-professional organizations, socio-professional organizations, and social organizations;

- Enterprises, cooperatives, business households, and other economic organizations;

- Research institutes, universities, experts, and scientists.

3. Content of collecting people's opinions on the draft Land Law (amended) in Vietnam

- Collect opinions on the draft Land Law (amended), including the layout, content, and presentation techniques of the draft Land Law (amended).

- Collect opinions on some key issues of the draft Law, including:

(1) Planning and land use plans;

(2) Land recovery and compensation, support, and resettlement policies;

(3) Land fund development;

(4) Land allocation, land lease, change of land use purpose;

(5) Land registration, issuance of certificates and administrative procedures, land data, and information;

(6) Financial mechanisms and policies; land prices;

(7) Regime for management and use of land types;

(8) Decentralization, supervision, and control of power;

(9) Households using land.

- The key contents, according to each group of respondents, are as follows:

+ People from all walks of life in the country and Vietnamese people residing abroad:

(1) Cases of land recovery for socio-economic development for national and public benefits;

(2) Order and procedures for land recovery, issuance of certificates of land use rights, ownership of houses, and other assets attached to land;

(3) Regulations on compensation, support, and resettlement;

(4) Regarding expanding the limit for receiving the transfer of agricultural land use rights of households and individuals;

(5) Regarding expanding the subjects receiving the transfer of rice land use rights;

(6) Authority to resolve land disputes;

(7) Land policy for ethnic minorities.

+ Enterprises, cooperatives, business households, and other economic organizations:

(1) Cases where the State leases land with a one-time payment for the entire rental period and leases land with an annual land rental payment;

(2) Regulations on compensation and support when the state recovers land;

(3) Cases of auctioning land use rights and bidding for projects using land;

(4) Use of land to implement investment projects through land use rights agreements;

(5) Allowing the transfer and mortgage of lease rights in land lease contracts with annual payments;

(6) Principles for determining land prices, land price list, specific land prices;

(7) Cases of exemption or reduction of land use fees and land rent;

(8) Land use regime in industrial zones.

+ State agencies at the Central and local levels; political organizations, socio-political organizations, socio-political-professional organizations, social organizations, and socio-professional organizations:

(1) Authority to allocate land, lease land, and permit change of land use purpose;

(2) Regarding land users and land-using households;

(3) Basis, authority, order, and procedures for establishing and adjusting land use planning and plans;

(4) Great land policy for ethnic minorities;

(5) Cases of land recovery for socio-economic development for national and public benefits;

(6) Regulations on compensation and support when the state recovers land;

(7) Use of land to implement investment projects through agreements on land use rights;

(8) Permission to transfer or accept lease rights in land lease contracts with an annual payment;

(9) Principles for determining land prices, land price list, specific land prices;

(10) Authority to resolve land disputes.

+ Experts and scientists:

(1) Scope of adjustment;

(2) Explanation of terms;

(3) Content of planning and land use plans;

(4) Allowing the transfer and mortgage of lease rights in land lease contracts with annual payments;

(5) Multi-purpose land use regime, land for underground and aerial construction;

(6) Principles for determining land prices, land price list, specific land prices.
