The Minister of Industry and Trade has just signed and promulgated Circular 11/2020/TT-BCT stipulating the Rules of Origin of Goods in the Free Trade Agreement between Vietnam and the European Union.

Circular 11/2020/TT-BCT stipulates the documents used to prove the origin of goods requesting the issuance of a Certificate of Origin (C/O) or the issuance of self-certification of origin under the Free Trade Agreement between Vietnam and the European Union (EVFTA) include:
- Documents proving the production process or processing stage performed by the exporter or manufacturer, such as reports or internal accounting records.
- Documents used to prove the origin of materials that are issued or declared in a Member State according to current regulations.
- Documents proving the processing stage or processing of materials, issued or declared in a Member State according to current regulations.
- Documents certifying the origin of materials that are issued or declared in a Member State as stipulated in this Circular.
In addition, Circular 11/2020/TT-BCT stipulates that the verification and examination of documents certifying the origin of goods are conducted on a random basis or when the competent authorities of the importing Member State have reasonable doubts about the authenticity of the documents, the origin of the goods, or compliance with other EVFTA provisions.
According to the above regulations, the competent authorities of the importing Member State resend the C/O, submitted invoice, or self-certification of origin documents or copies of these documents to the competent authorities of the exporting Member State and provide suitable reasons for requesting verification. Documents and information indicating discrepancies or inaccuracies in the information shown on the origin certification documents are attached to the verification request. The competent authorities or customs authorities of the exporting country notify the competent authorities of the importing country upon receipt of the request for verification of the origin certification documents. This notification can be made in any form, including electronic form.
