04 cases of termination of temporary custody of goods under the Istanbul Convention

Recently, the Government of Vietnam has just signed and promulgated Decree 64/2020/ND-CP guiding the implementation of the temporary admission mechanism under the Istanbul Convention.

In Article 7 of Decree 64/2020/ND-CP stipulates 04 cases of ending temporary admission of goods according to the Istanbul Convention from July 30, 2020, specifically:

- Temporarily admitted goods that have completed re-export procedures (including the case of completing re-export procedures to send to bonded warehouses, bringing into non-tariff zones), re-import, proof of re-import, re-export:

+ For temporarily imported goods for re-export, it is the ticket stub confirmed, stamped by the Vietnamese customs authority, and the re-export ticket stub or declaration that has completed customs procedures in case of re-exporting goods by paper customs declaration;+ For temporarily exported goods for re-import, it is the ticket stub and re-import ticket stub confirmed, stamped by the Vietnamese customs authority, or the declaration that has completed customs procedures in case of re-importing goods by paper customs declaration.

- Temporarily admitted goods that are not re-exported or re-imported have completed the procedures for changing the purpose of use (including giving, gifting), transferring for domestic consumption.

- Goods destroyed by decision of the competent authority, goods damaged, severely destroyed, entirely lost due to accidents or force majeure as confirmed by the competent authorities and have completed tax obligations as prescribed by law for temporarily imported goods for re-export, temporarily exported goods for re-import.

- Temporarily admitted goods confiscated by competent authorities following the law of the country of temporary admission.
