03 Principles of Investment in Construction and Business of Golf Courses

According to Decree No. 52/2020/ND-CP, it is stipulated that "A golf course is a construction project comprising golf paths and auxiliary facilities designed according to appropriate scale and technical standards to serve golf players" and "Golf course business is the provision of services such as golfing, practicing, competing, and related services to serve golfers".

Investment in the construction and business of golf courses must comply with the following principles:

1. The investment and construction activities and the business of golf courses aim to promote socio-economic development, services, tourism, and sports; to meet the need for diverse forms of entertainment, and to develop physical fitness and public health.

2. The implementation of golf course projects should not affect national defense, security, social order, social safety, social ethics, public health, the environment, natural resources, historical-cultural relics, and scenic spots that are recognized and protected by competent state agencies according to legal provisions; ensure the legal rights, interests, and social welfare of people whose land is requisitioned for golf course construction.

3. The land used for constructing golf courses must conform to land use planning and plans; ensure that it is used for the right purpose, efficiently, and economically; meet conditions and procedures as prescribed by this Decree and the laws on investment, planning, land, construction, environment, and relevant legislation.

Additionally, the Decree also clearly states the conditions for operating a golf course business as follows: The provision of golf playing services, the operation of golf practice, competitions, and related services must meet the conditions regarding physical facilities, equipment, financial resources, and human resources as stipulated by the laws on physical training and sports.
