On December 27, 2016, the Government of Vietnam promulgated Decree 170/2016/ND-CP stipulating the announcement, reception, handling, and transmission of maritime security information.
Decree 170 classifies maritime security levels into the following 3 levels:
- Level 1: Normal level, requiring the implementation of minimum security measures under normal operational conditions of sea-going vessels, mobile platforms, or port facilities.- Level 2: Enhanced level, requiring higher security measures during periods of heightened security risk for sea-going vessels, mobile platforms, or port facilities.- Level 3: Special level, requiring the implementation of special security measures during periods of imminent or probable security incidents involving sea-going vessels, mobile platforms, or port facilities.
According to Decree 170, the maritime security levels are maintained and changed as stipulated below:
- Level 1 is constantly maintained on Vietnamese sea-going vessels, mobile platforms, and at Vietnamese port facilities;- Level 3 is only applied when there is reliable information, clearly identifying an imminent or probable security incident involving sea-going vessels, mobile platforms, or port facilities;- Maritime security levels may be changed in order from Level 1 to Level 2 and Level 3, or may directly shift from Level 1 to Level 3, depending on actual conditions and circumstances;- The change in maritime security levels must be implemented according to the announcement by competent agencies or organizations and promptly notified to relevant agencies, organizations, and individuals as stipulated in this Decree and other relevant provisions of the law.
