December 10, 2012, the Ministry of Home Affairs issued Circular 09/2012/TT-BNV regulating the procedures and contents of inspection concerning the recruitment, utilization, and management of officials and public employees in Vietnam.
03 Important contents of the conclusion of the official and public employee Inspection (Illustrative photo)
According to Article 15 of Circular 09/2012/TT-BNV, the person making the inspection decision directs the Chief of the inspection team to preside over the drafting of the inspection conclusion. The draft inspection conclusion is sent to the members of the inspection team for comments before being sent to the inspected entity for feedback. If the members of the inspection team have differing opinions on the contents of the draft inspection conclusion, the Chief of the inspection team considers and makes a decision.
In necessary cases, the person making the inspection decision may seek the opinion of a professional agency or send the draft inspection conclusion to the inspected entity. The feedback from the professional agency and the inspected entity on the draft inspection conclusion must be in writing and accompanied by supporting documents.
The person making the inspection decision directs the Chief of the inspection team to research and propose the handling direction for the explanations of the inspected entity and the feedback from the professional agency.
Notably, the contents of the inspection conclusion in Vietnam include:
- Results of examination and verification of each inspection content;
- Conclusion on the compliance with legal regulations of the inspected entity related to the inspection content; clearly identifying the nature, extent of violations, causes, and responsibility of the agencies, organizations, and individuals committing the violations (if any);
- Recommendations to competent authorities to amend, supplement, and issue regulations on the recruitment, use, and management of officials and public employees to meet management requirements or to abolish illegal regulations discovered through the inspection (if any).
