03 PPP Project Evaluation Council (illustrative image)

Article 6 of the Law on Investment in the Form of Public-Private Partnership 2020 provides for the PPP Project Evaluation Council as follows:

Regarding the PPP Project Evaluation Council, it includes 3 councils for the following types of projects:

- The State Evaluation Council performs the task of evaluating the pre-feasibility study reports and feasibility study reports of PPP projects approved by the National Assembly;- The Inter-agency Evaluation Council performs the task of evaluating the pre-feasibility study reports and feasibility study reports of PPP projects approved by the Prime Minister of the Government of Vietnam;- The Grassroots Evaluation Council performs the task of evaluating the pre-feasibility study reports and feasibility study reports of PPP projects approved by the Minister, head of the central authority, other agencies, and the Provincial People's Council, except where the evaluation task is assigned to a unit under the competent authority stipulated in Clause 3, Article 6 of the Law on Investment in the Form of Public-Private Partnership.

Regarding the establishment of evaluation councils, it is regulated as follows:

- Upon the proposal of the Minister of Planning and Investment: The Prime Minister of the Government of Vietnam decides to establish the State Evaluation Council and the Inter-agency Evaluation Council;- The Minister, head of the central authority, other agencies, and Chairman of the Provincial People's Committee establish the Grassroots Evaluation Council or assign a unit under them to carry out the task of evaluating the pre-feasibility study reports and feasibility study reports of PPP projects.
