Recently, the Ministry of Justice of Vietnam issued Circular 14/2014/TT-BTP on guidance on Decree 59/2012/ND-CP regarding the monitoring of law enforcement activities in Vietnam.
03 Contents for Reviewing and Assessing the Situation of Ensuring Conditions for Law Enforcement in Vietnam (illustration)
Circular 14/2014/TT-BTP stipulates 03 essential contents to review and assess the conditions for law enforcement in Vietnam. Based on the information sources stipulated for evaluating the consistency and synchronization of detailed regulatory documents, specialized agencies in Vietnam will review and evaluate the conditions for law enforcement according to the following basic contents:
Determine the training and law dissemination needs for each specific field and subject, contrast with the activities, contents, forms, and subjects of law training and dissemination that have been implemented, evaluate the adequacy, promptness, and suitability of law training and dissemination activities, the impact of law training and dissemination on the compliance awareness and level of legal knowledge enhancement among agencies, organizations, and citizens, propose solutions to improve the effectiveness of law dissemination and training, and send it to the justice agency at the same level for monitoring and summarizing;
Determine the needs for organizational structure, quantity, and standards of officials and public employees meeting the requirements of law enforcement work, contrast with the actual situation, evaluate the suitability of the organizational structure and the extent of human resource fulfillment, propose measures to ensure organization, staffing, and human resources, and send it to the agency in charge of personnel organization at the same level for summarizing and processing, while also sending it to the justice agency at the same level for overall monitoring and summarizing;
Determine the needs for funding, equipment, and facilities meeting the requirements of law enforcement work, contrast with the assurance reality, evaluate the extent of fulfillment by the assurance, propose measures to ensure funding, equipment, and facilities, and send it to the agency in charge of financial work at the same level for summarizing and processing, while also sending it to the justice agency at the same level for overall monitoring and summarizing.
The justice agency shall preside, cooperate with the agency in charge of personnel organization and the agency in charge of financial work at the same level to summarize, analyze, and review the proposals stipulated at the above points, and report to the Minister, the head of the agency at the ministerial level, the agency under the Government of Vietnam, and the People's Committee at the same level for consideration and handling according to their competence or propose the competent agency for consideration and handling.
