Consolidated Document 27/VBHN-VPQH of 2024 consolidating the Housing Law issued by the Office of the National Assembly

Consolidated Document 28/VBHN-VPQH of 2024 consolidating the Real Estate Business Law issued by the Office of the National Assembly

Reason: The Land Law 2024, Housing Law 2023, and Real Estate Business Law 2023 are amended by the 2024 Law Amending the Land Law, Housing Law, Real Estate Business Law, and Law on Credit Institutions.

State management on land in Vietnam

  1. Promulgate and organize the implementation of legal documents on the management and use of land.

  2. Propagate, disseminate, educate, train, conduct scientific research, develop technology, and engage in international cooperation in land management and use.

  3. Determine administrative unit boundaries and establish and manage administrative boundary records.

  4. Survey, adjust, and create cadastral maps, land use status maps, land use planning maps, and specialized maps on land management and use.

  5. Investigate, evaluate, protect, improve, and restore land.

  6. Develop, adjust, and manage land use planning and plans.

  7. Allocate land, lease land, recover land, recognize land use rights, requisition land, and convert land use purposes.

  8. Investigate and construct land price tables, specific land prices, and manage land prices.

  9. Manage finances related to land.

  10. Compensate, assist, and relocate when the State recovers or requisitions land.

  11. Develop, manage, and exploit land funds.

  12. Register land; establish and manage cadastral records; issue, correct, revoke, and cancel certificates.

  13. Conduct land statistics and inventory.

  14. Build, manage, operate, and exploit the national land information system.

  15. Manage and oversee the implementation of land users' rights and obligations.

  16. Resolve land disputes; resolve complaints and denunciations about land.

Policies for development, management, and use of housing in Vietnam

The State has policies to develop housing, facilitating everyone to have a place to live by promoting the development of diverse types of housing, including housing for sale, rent-purchase, and leasing in accordance with the needs and financial capacity of individuals and families, providing capital support for housing renovation and reconstruction; The State invests in constructing social housing with either partial or full public investment (hereinafter collectively referred to as public investment capital) for rent or rent-purchase.

The State is responsible for creating a homestead land fund through the approval of land use planning, land use plans, construction planning, urban planning, and functional area planning.

The State issues mechanisms and policies regarding planning, land, finance, credit, scientific research, technology application, and new building materials to encourage economic components to invest in housing development and to encourage organizations and individuals to participate in housing development for sale, rent-purchase, and leasing under market mechanisms.

The State issues preferential mechanisms and policies on financial matters related to land, long-term credit at preferential interest rates, other financial incentives, and support from State capital to implement policies on social housing, renovation, and reconstruction of old apartment buildings.

The State has policies to encourage the research and issuance of sample designs and typical designs for each type of housing suitable for each area, region, locality; has policies to encourage the development of energy-saving housing.

The People's Committee of provinces and centrally-administered cities (hereinafter collectively referred to as provincial People's Committees) has the responsibility for planning, allocating land, and investing in building social housing according to the provisions of this Law and other relevant laws.

The State has policies on the management and use of housing to ensure efficiency, safety, and proper purpose and functionality of housing use.

State policies on investment in real estate business in Vietnam

The State encourages organizations and individuals from economic sectors to invest in real estate business in line with the socio-economic development objectives of the country in each period and locality.

The State encourages and provides preferential policies for organizations and individuals investing in the construction of social housing and real estate projects eligible for investment incentives.

The State invests in and encourages organizations and individuals to invest in the construction of technical infrastructure works outside of the project scope and supports investment in the construction of technical infrastructure works within the project scope of real estate projects eligible for investment incentives.

The State invests in and encourages organizations and individuals to invest in urban public service projects and social infrastructure works within the scope of real estate projects.

The State has policies to regulate the real estate market, ensuring that the real estate market develops healthily, safely, and sustainably.

The State has policies for organizations and individuals to make non-cash payments in real estate transactions.

The State encourages organizations and individuals to conduct transactions of purchase, transfer, lease, rent-purchase, and re-lease of housing, constructed works, and land use rights through real estate exchanges.
