03 cases where agencies of the Communist Party can lease property for operations in Vietnam (Illustration)

To be specific, in Article 14 of Decree 165/2017/ND-CP, it stipulates that the agency of the Communist Party is allowed to rent property for operational purposes when there is no property available or there is a lack of property compared to the standards and norms  in Vietnam, under the following circumstances:

1. No property to assign and not eligible for cost allocation for property use;
2. Need to use the property for a short period or infrequently;
3. Renting property is more efficient than investing in building or purchasing.

Note: The method of renting and selection of service providers for property rental shall comply with the provisions of the law.

At the same time, the authority to decide on the rental of property for operational purposes at the agency of the Communist Party is regulated as follows:

- The Chief of the Central Office of the Communist Party decides or delegates the authority to decide on the rental of property from the state budget for operational purposes at the agency of the Communist Party at the central level;

- The competent authority in accordance with the regulations on the management and use of the central Communist Party budget reserve fund decides or delegates the authority to decide on the rental of property from the central Communist Party budget reserve fund for the operational purposes of the agency of the Communist Party at the central level;

- The Standing Committee of the Provincial Party Committee decides or delegates the authority to decide on the rental of property from the state budget and the local Communist Party budget reserve fund for operational purposes at the agency of the Communist Party, which is a subordinate unit directly under the Office of the Provincial Party Committee;

- The Standing Committee of the District Party Committee decides on the rental of property from the district Communist Party budget reserve fund for operational purposes at the agency of the Communist Party, which is a budget estimation unit under the district state budget in Vietnam;

- Following the delegation of the Provincial People's Council regarding the rental of property from the state budget for the operational purposes of the Office of the District Party Committee, which is a budget estimation unit under the district state budget in Vietnam.

Details can be found in Decree 165/2017/ND-CP, which comes into force in Vietnam from January 01, 2018.
