According to Article 14 of Decree 94/2013/ND-CP, national reserve goods that are damaged or have quality reduction compared to current technical standards but still have usable value and are permitted for circulation in the market are liquidated in the following cases in Vietnam:
Heads of ministries and central authorities managing national reserve goods decide the liquidation of national reserve goods according to legal regulations. The method, sequence, procedures, and organization for the liquidation of national reserve goods follow the legal regulations on the management and use of state property.
The money collected from the liquidation of national reserve goods, after deducting reasonable costs for liquidation work according to legal regulations, is submitted to the state budget.
Additionally, this Decree also provides regulations on the exclusion from the detailed list of national reserve goods. National reserve goods not included in the detailed list of national reserve goods prescribed in this Decree, the heads of ministries and central authorities managing national reserve goods propose to the Prime Minister of the Government of Vietnam to decide on their exclusion from the detailed list of national reserve goods; The method of disposal follows the regulations of the Law on National Reserves. National reserve goods used for defense and security, once excluded from the list, are only disposed of for defense and security purposes.
Note: The proceeds from the disposal of national reserve goods are submitted to the state budget.
