02 bidding principles of drug categories for supply of drugs for public health facilities in Vietnam

Bidding of drug categories in a contract package must comply with the 02 principles specified in Article 12 of Circular No. 15/2019/TT-BYT of the Ministry of Health of Vietnam, specifically as follows:

- Contractors shall be sorted according to technical criteria that their drugs satisfy. If a drug satisfies criteria of more than one category, its supplier may be divided into one or some categories corresponding to the technical criteria their drug satisfies, and provided the bid price for the same drugs in all categories participated by the contractor are consistent.

- If an offered drug is manufactured by several facilities, these facilities participating in the production process shall satisfy technical criteria of the offered drug category.

Besides, Circular No. 15/2019/TT-BYT also specifies bidding packages for supply of drugs for public health facilities, in particular:

- Contract package of generic:

+ Drugs satisfying criteria of Category 1 may be sorted into Category 1, Category 2, Category 5;

+ Drugs satisfying criteria of Category 2 may be sorted into Category 2, Category 5;

+ Drugs satisfying criteria of Category 3 may be sorted into Category 3, Category 5;

+ Drugs satisfying criteria of Category 4 may be sorted into Category 4, Category 5;

+ Drugs not satisfying criteria of Category 1, Category 2, Category 3 and Category 4 shall only be sorted into Category 5.

- Contract package of herbal drugs and traditional drugs:

+ Drugs satisfying criteria of Category 1 may be sorted into Category 1, Category 2 and Category 3;

+ Drugs satisfying criteria of Category 2 may be sorted into Category 2 and Category 3;

+ Drugs not satisfying criteria of Category 1, Category 2 shall only be sorted into Category 3.

- Contract package of herbal ingredients:

+ Herbal ingredients satisfying criteria of Category 1 may be sorted into Category 1 and Category 3;

+ Herbal ingredients satisfying criteria of Category 2 shall only be sorted into Category 2;

+ Herbal ingredients not satisfying criteria of Category 1, Category 2 shall only be sorted into Category 3.

Details of categories 1, 2 and 3 can be found in Circular No. 15/2019/TT-BYT of the Ministry of Health of Vietnam, which takes effect from October 01, 2019.
