Regarding this issue, LawNet would like to answer as follows:

On October 19, 2023, the Government issued Decree 75/2023/ND-CP amending and supplementing a number of articles of Decree 146/2018/ND-CP guiding the Law on Health Insurance.

02 Additional subjects entitled to 100% of medical costs paid by the policyholders as of December 3, 2023 in Vietnam

Specifically, Point a, Clause 5, Article 1 of Decree 75/2023/ND-CP has added subjects entitled to 100% of medical costs paid by the policyholders as follows:

- 02 Additional subjects entitled to 100% of medical costs paid by the policyholders:

+ People participating in the resistance war and defending the Fatherland.

+ People in safe zone communes and revolutionary safe zones during the resistance war against the French and Americans who are currently residing in safe zone communes during the resistance wars against the French and Americans have been updated with information in the National Database but are not subject to provisions in Clauses 1, 2 and 3 of Article 12 of the Law on Health Insurance.

- According to current regulations, the following subjects are entitled to 100% health insurance, including:

+ People with meritorious services to the revolution, according to the provisions of the Ordinance on preferential treatment for people with meritorious services to the revolution.

+ Veterans;

+ People eligible for monthly benefits and social assistance according to the provisions of the law on the elderly, disabled people, and social assistance.

+ People from poor households; ethnic minorities living in areas with difficult socio-economic conditions; people living in areas with particularly difficult socio-economic conditions; people living in island communes, island districts, and some other subjects.

+ Relatives of martyrs

+ People aged 80 or older are receiving monthly death benefits according to the provisions of the law on social insurance.

03 additional subjects eligible for 95% of medical costs paid by the policyholders in Vietnam

In addition, Point b, Clause 5, Article 1 of Decree 75/2023/ND-CP has added subjects eligible for 95% of medical costs paid by the policyholders in Vietnam as follows:

- Martyr's spouse marries another husband/wife who is receiving monthly benefits in the case of raising a martyr's child to adulthood, taking care of a martyr's biological father or mother while still alive, or because of revolutionary activities without having the conditions to care for the martyr's biological father or mother while still alive.

- People who serve people with meritorious services living at home include: People who serve Vietnamese Heroic Mothers; people serving war invalids; people receiving policies such as war invalids; sick soldiers; and resistance activists exposed to toxic chemicals who suffered 81% of their injuries.

- Ethnic minorities living in communes of regions II, III, and extremely difficult villages in ethnic minority and mountainous areas in the period of 2016–2020 that are no longer on the list of communes in regions II, III, and extremely difficult villages in ethnic minority and mountainous areas in the period of 2021–2025

According to current regulations, the following subjects are entitled to 95% of medical examination and treatment costs:

- Persons eligible to be entitled to retirement pensions and incapacity benefits

- Relatives of people with meritorious service, except for the subjects specified in Clause 11, Article 3 of Decree 146/2018/ND-CP.

- Members in near-poor households, as defined according to the near-poor household criteria for the period 2022-2025 prescribed in Decree No. 07/2021/ND-CP and subsequent amendments or replacements thereto;

- Members of multidimensional-poverty family households falling into the cases specified in point a, clause 9, Article 3 of Decree 146/2018/ND-CP.
