Vietnam's outstanding new policy takes effect from the end of October 2021

LawNet would like to introduce to customers the following outstanding new policies effective from the end of October 2021 (from October 21 to October 31, 2021):

1. Dossier of establishing and putting the hydrometeorological station into official operation in Vietnam

This is one of the notable contents in Circular 13/2021/TT-BTNMT of Vietnam regulating the establishment, relocation and dissolution of the national hydro-meteorological station, which officially took effect on October 21, 2021.

According to the Circular, a dossier of the establishment of a hydro-meteorological station includes:

- The report of the agency or unit implementing the project;

- Decision approving the technical survey report on station establishment and technical survey report on station establishment;

- A written approval from a competent agency or organization or individual on the location and area of ​​land use for construction of professional works, stations, installation of measuring equipment and means;

- A copy of the competent authority's decision approving the investment project or policy on station establishment.

In addition, the dossier for putting the station into official operation includes:

- The report of the agency or unit implementing the project;

- A copy of the decision to establish the station;

- A competent authority's decision on land allocation or a copy of the certificate of land use rights (if any); Certification of the local government, organization or individual for the leased land area, land not subject to the grant of land use right certificates;

- Minutes of acceptance of works, equipment and measuring devices;

- A copy of the decision approving the maintenance project;

- Copies of documents on verification and calibration of hydrometeorological measuring instruments and technical documents; instructions for use, operation, maintenance and maintenance of measuring instruments;

- Report on evaluation of test operation, monitoring and inspection results according to Form No. 2, Appendix II issued together with Circular 13/2021 ;

- Written opinions of specialized agencies under the General Department of Meteorology and Hydrology.

Note: For stations that have submitted their application for establishment before October 21, 2021, they will continue to comply with Decision 03/2006/QD-BTNMT of Vietnam.

2. Guidelines for training doctoral and master's degrees for Vietnamese lecturers

Circular 25/2021/TT-BGDĐT of Vietnam guiding the implementation of doctoral and master's degree training for lecturers of higher education institutions under Decision 89/QD-TTg, effective from 24 October 2021.

The regulations on qualifications and training majors of masters and doctoral for lecturers include:

- Doctoral training in all disciplines;

Prioritize those industries that need to be focused on training in Vietnam's high-skilled human resource development strategy from time to time until 2030 and in the next period;

- Training at the master's level in the fields of art and the group of physical training and sports industries.

In addition, forms of master's and doctoral training for lecturers include:

- Full-time focused training in the country;

- Full-time intensive training abroad;

- Associate in doctoral training with a part of the domestic study period and a part of the overseas study period, in which the maximum duration of overseas training is not more than 02 years (newly added content)

3. Compulsory assessment of foreign language ability on computer from July 1, 2023

This is a prominent new content in Circular 24/2021/TT-BGDDT amending Circular 23/2017/TT-BGDDT on Regulations on foreign language ability assessment exam according to 6-level foreign language competency framework for Vietnam effective October 24, 2021.

Specifically, Circular 24/2021 of Vietnam stipulates that from July 1, 2023, all skills will be held on computers.

Currently, the skills of listening, reading, and writing are tested on paper or on a computer.

In addition, the number of exam questions and exam questions has also changed from July 1, 2022, specifically:

- From July 1, 2022, the number of exam questions is the same time for the exam format for elementary students, middle school students, and high school students: English must have at least 50 exam questions, for each other foreign language subject must have at least 30 exam questions; in which the number of questions overlapping between the exam questions does not exceed 10%;

- From July 1, 2022, the number of exam questions is the same time as the format of the exam questions for other subjects: For English, there must be at least 70 questions, for each subject. Other foreign languages ​​must have at least 30 exam questions; in which the number of questions overlapping between exam questions does not exceed 10%;

Every year, units must review and adjust the exam question bank and add at least 10% of the number of questions for each skill...

4. Expenses for implementation of the Intellectual Property Development Program

Circular 75/2021/TT-BTC of Vietnam stipulates financial management for the implementation of the Intellectual Property Development Program to 2030, effective from October 25, 2021.

The content and spending levels for the task of promoting the registration of intellectual property protection at home and abroad are as follows:

- For domestic protection registration:

+ For applications for registration of invention protection and registration for protection and recognition of new plant varieties: VND 30 million/application;

+ For registration applications for protection of industrial designs and trademarks: 15 million VND/protection title.

(Currently, Circular 14/2019/TT-BTC has no regulations on trademarks).

- For overseas protection registration for the above objects: 60 million VND/application is accepted as valid, corresponding documents according to regulations of the international organization or the applicant country.

- For tasks managed by ministries and central agencies, the above-mentioned funding level is the maximum support level from the state budget, in case of other additional costs (if any), units participating in the Self-Assurance Program;
