Outstanding new policy effective from the end of February 2022

1. Increase the level of support for workers who have to return home early due to an accident

This is a notable content in Decision 40/2021/QD-TTg  on the Overseas Employment Support Fund, effective from February 21, 2022.

Specifically, supporting workers who have to return home ahead of time due to a labor accident, accident, illness, or disease to the point that they are no longer able to continue working abroad.

Support level: from 10,000,000 VND to 30,000,000 VND/case.

(Currently, the maximum support level is 5,000,000 VND/case).

The employee or the employee's authorized person or the employee's legal representative shall send a request for support enclosed with 01 set of documents to the Fund's operating agency.

Profile include:

- A copy of the document on liquidation of the contract signed between the sending enterprise, organization or individual and the employee, clearly stating the reason for returning home ahead of time;

Or the employer's written notice of the termination of the contract for the employee for the above reasons;

- A copy of the employee's medical examination paper or other document proving the illness or injury, issued by the health authority of the host country;

- A copy of the employee's passport;

- Power of attorney (specify content of authorization) or documents proving the right to represent at law as prescribed in case the authorized person or the legal representative submits the application.

2. Eliminate fees for project appraisal and report on discharge of wastewater into water sources

The Ministry of Finance promulgates Circular 01/2022/TT-BTC on collection rates, regimes for collection, payment, management and use of fees for exploitation and use of water sources implemented by central agencies, effective from the date of this Circular. February 25, 2022.

Accordingly, the fee for project appraisal and report on wastewater discharge into water sources and the fee for project appraisal and report on wastewater discharge into water sources will be abolished for aquaculture activities.

In addition, Circular 01/2022/TT-BTC also stipulates a number of fees as follows:

- Appraisal of the underground water exploration project, the fee is from 7.6 to 16.4 million VND/document.

- Appraise the report on the current status of underground water exploitation, the fee rate is from 8 to 18.4 million VND/document.

- Appraisal of dossiers, conditions for large-scale underground water drilling practice, fee of 3 million VND/document.

- Appraisal of the project on exploitation and use of sea water, the fee is from 12.8 to 28.8 million VND/document.

3. Regulations on nursing activities in hospitals from February 27, 2022

The Ministry of Health issued Circular 31/2021/TT-BYT regulating nursing activities in hospitals, effective from February 27, 2022.

Accordingly, the regulations on the classification of patient care are as follows:

- Level I care : patients in serious and critical condition who cannot perform daily personal activities or because of professional requirements cannot exercise must depend entirely on monitoring and comprehensive care. and continuity of nursing.

- Level II care : the patient is in a serious condition, with limited mobility partly because of his health condition or due to professional requirements, and must limit movement. care while performing personal daily activities.

- Level III care : the patient is able to move, walk without limitation and perform all or most of his/her personal daily activities under the guidance of a nurse.

In addition, nursing care must follow the following principles:

- Clinical identification, care decentralization and implementation of nursing care interventions for patients must be professional, comprehensive, continuous, safe, quality, fair among patients and appropriate. with the needs of each patient.

- The performance of nursing activities in the hospital must ensure the participation and coordination of other units and professional titles in the hospital.

4. Passing 01 law, 04 resolutions at the first extraordinary session of the XV . National Assembly

 Resolution 46/2022/QH15 on the first extraordinary session, the XV National Assembly, approved 01 law, 04 resolutions including:

- Law amending and supplementing a number of articles of  Law on Public Investment ,  Law on Investment in the form of public-private partnership ,  Law on Investment ,  Law on Housing ,  Law on Bidding ,  Law on Electricity ,  Law on Enterprises ,  Law on Consumption Tax Special Concessions  and  the Law on Execution of Civil Judgments .

- Resolution 43/2022/QH15  on fiscal and monetary policies to support the program of socio-economic recovery and development;

-  Resolution 44/2022/QH15  on investment policy of the East North-South expressway construction project in the 2021-2025 period;

-  Resolution 45/2022/QH15  on piloting a number of specific mechanisms and policies for the development of Can Tho city;

-  Resolution 46/2022/QH15  on the first extraordinary session of the XV National Assembly.

Resolution 46/2022/QH15  takes effect from February 25, 2022.
