The Law Clerk would like to introduce to customers the following outstanding new policies that will take effect from the beginning of March 2022 (from March 1 to March 10, 2022):

1. Exemption of registration fee for electric cars for 3 years from March 1, 2022

This is a notable content in Decree 10/2022/ND-CP  regulating registration fees, effective from March 1, 2022.

Specifically, the registration fee for battery electric cars is as follows:

- Within 3 years from March 1, 2022, pay the first registration fee at the rate of 0%;

- Within the next 2 years, pay the first registration fee at a rate equal to 50% of the fee for petrol and diesel cars with the same number of seats.

The registration fee for the second time onwards is 2% and uniformly applied nationwide.

Thus, battery electric cars will be exempted from registration fees for the first time for 3 years from March 1, 2022.

In addition, for passenger cars with 9 seats or less (including pick-up cars), the first registration fee is payable at the rate of 10%. In case it is necessary to apply a higher fee, the People's Council of the province or city under central authority shall decide to increase it, but not exceeding 50% of the general regulation.

Cargo pick-up trucks have a permissible carrying volume of less than 950 kg and have 5 seats or less, and VAN trucks have a permissible carrying volume of less than 950 kg. pay the first registration fee at a rate equal to 60% of the first registration fee for passenger cars with 9 seats or less.

2. 06 cases of real estate business without having to establish a business from March 1, 2022

Effective from March 1, 2022, Decree 02/2022/ND-CP  detailing the implementation of a number of articles of  the Law on Real Estate Business stipulates 06 cases of non-mandatory real estate business. Business establishment includes:

(1) Agencies or organizations selling houses and construction works, transferring land use rights due to bankruptcy, dissolution or division in accordance with law.

(2) Agencies or organizations that sell, transfer, lease, lease-purchase real estate as public property in accordance with law.

(3) Credit institutions, foreign bank branches, asset management companies of credit institutions (AMCs), asset management companies of Vietnamese credit institutions (VAMC) perform selling houses, construction works, transferring land use rights, transferring real estate projects being used as guarantees or mortgages for debt recovery in accordance with law.

(4) Organizations, households and individuals selling houses, construction works, transferring land use rights under decisions of courts or competent state agencies when settling disputes, complaints, denounce.

(5) Organizations, households and individuals that sell, lease, lease-purchase houses and construction works under lawful ownership, transfer, lease, and sub-lease land use rights under their ownership rights. its legal.

(6) Organizations, households and individuals that sell, lease, lease-purchase or transfer real estate they invest in and build, which are not real estate construction investment projects for business according to regulations. provisions of the law.

However, it should be noted that the above 06 subjects are not required to establish a real estate business only in the case of small-scale and irregular real estate sale, transfer, lease, or lease-purchase.

3. Occupational accident allowance from March 1, 2022

From March 1, 2022, the occupational accident allowance level shall comply with Circular 28/2021/TT-BLDTBXH .

Accordingly, an employee who suffers an occupational accident that reduces his working capacity by 5% or more or a worker's family member who dies due to an occupational accident is entitled to the occupational accident allowance regime, if the cause occupational accident occurred entirely due to the fault of the injured worker (according to the conclusion of the occupational accident investigation report).

Specifically, the subsidy levels are as follows:

- At least 12 months' salary for employees whose working capacity is reduced by 81% or more or for employees' relatives who die due to occupational accidents;

- At least equal to 0.6 months' salary for people with working capacity decrease from 5% to 10%; if the working capacity is reduced from 11% to 80%, it shall be calculated according to the following formula:

Ttc = Tbt x 0.4

In there:

- TTc: Allowance for employees whose working capacity is reduced by more than 10% (unit: monthly salary);

- Tbt: Compensation level for people whose working capacity is reduced by more than 10% (unit: monthly salary).

4. Add 02 online contractor selection costs

Circular 06/2021/TT-BKHĐT  detailing the collection, payment, management and use of fees for registration, information posting, and selection of contractors and investors on the national bidding network system Bidding Newspaper, effective from March 1, 2022.

Accordingly, adding 02 new costs when selecting contractors and investors on the National Procurement Network, including:

Cost of the winning contractor : calculated at 0.022% of the winning bid, but the maximum is VND 2,200,000 (VAT included).

For a bidding package divided into several parts or separate lots, the cost of the winning contractor shall be calculated according to the winning value of each separate part or lot;

Cost of using e-contract : calculated at 0.022% of the contract price but maximum VND 2,200,000 (VAT included).

Note : These two types of costs are applied from January 1, 2023 and are based on the Decision of the Minister of Planning and Investment.
