The Law Clerk would like to introduce to customers the following outstanding new policies effective from the beginning of February 2022 (from February 1 to February 10, 2022):

1. Increase the maximum overtime for seasonal workers from February 1, 2022

The Ministry of Labour, Invalids and Social Affairs has issued  Circular 18/2021/TT-BLDTBXH  stipulating working time and rest time for employees doing seasonal production jobs and processing jobs according to orders. , effective from February 1, 2022.

Accordingly, the limits of standard working hours and overtime hours per week and month are regulated as follows:

- The total number of standard working hours and overtime hours in a week must not exceed 72 hours.

(Currently,  Circular 54/2015/TT-BLDTBXH  stipulates no more than 64 hours; especially for employees doing particularly heavy, hazardous and dangerous occupations and jobs, no more than 48 hours).

- The total number of overtime hours in a month must not exceed 40 hours.

(Currently, the regulation does not exceed 32 hours; especially for employees doing particularly heavy, hazardous and dangerous occupations and jobs, no more than 24 hours).

The employer shall decide whether to apply the regulations on the number of working hours per week or by the month, and record it in the plan of working hours and rest periods in the year specified in Clause 2, Article 8 of  Circular 18. 2021 .

Thus, compared with the current,  Circular 18/2021  adjusts to increase overtime for employees doing seasonal production jobs and processing jobs according to orders.

2. Tariff quota for import of salt and poultry eggs in 2022

The Ministry of Industry and Trade promulgates  Circular 24/2021/TT-BCT  stipulating the principles of import management under tariff quotas for salt, poultry eggs and raw tobacco in 2022, effective from February 1, 2022 to the end of December 31, 2022.

Accordingly, the quantity of imports under tariff quotas for salt, poultry eggs and raw tobacco in 2022 is regulated as follows:

- For chicken eggs (goods codes are 0407.21.00 and 0407.90.10); duck and geese eggs (commodity codes are 0407.29.10 and 0407.90.20); other (codes are 0407.29.90 and 0407.90.90): 63,860 dozen.

- For salt (commodity code 2501): 80,000 tons (Number of temporary distribution for the first phase in 2022).

- For raw tobacco (commodity code is 2401): 65,156 tons.

Regarding the subjects of assignment of import tariff quotas:

- Tariff quotas on salt imports are assigned to traders directly for use as raw materials for chemical production and as raw materials for the production of drugs and medical products.

- Import tariff quotas for poultry eggs shall be assigned to traders wishing to import.

- Tariff quotas for import of raw tobacco shall be assigned to traders who have a license to produce tobacco issued by the Ministry of Industry and Trade and have a need to use raw tobacco for cigarette production.

3. Abolition of a number of fees in the diplomatic field from February 1, 2022

The Ministry of Finance promulgates  Circular 113/2021/TT-BTC  amending and supplementing a number of articles of  Circular 264/2016/TT-BTC  stipulating the rates, collection, payment, management and use of fees, fees in the field of diplomacy applied at Vietnamese representative missions abroad, effective from February 1, 2022.

Accordingly, a number of fees in the diplomatic field are abolished as follows:

- Abolish the fee for supplementing and amending passports  (currently the fee is 15 USD/book );

- Abolish the fee for issuing a passport  (currently, the fee for issuance of a passport is 20 USD/book, 40 USD/book for re-issue due to damage or loss) .

- Abolish the fee for issuance of Certificate of Citizenship Registration  (currently the fee is 5 USD/copy) .

In addition, the marriage registration fee is amended and supplemented as follows:

- Marriage registration is 70 USD/case.

- Marriage re-registration is 120 USD/case.

(Compared with the current one, amending the unit to charge for marriage registration from: 70 USD/copy to 70 USD/marriage case).

4. The title of Class I Heritage Officer must have a master's degree

The Ministry of Culture, Sports and Tourism promulgates  Circular 16/2021/TT-BVHTTDL  stipulating codes, standards for professional titles and salary classification of cultural heritage officials.

Accordingly, supplementing the professional title of class I heritage officer, in which the standards of training and retraining for the professional title of Class I heritage officer include:

- Possessing a master's degree or higher relevant to the field of cultural heritage;

- Possess a certificate of standardization of professional titles and professional titles of cultural heritage officers.

For public employees to participate in the exam or consider for promotion to the professional title of a class I heritage officer, they must meet the following requirements:

- Having held the professional title of class II heritage officer or equivalent for full 06 years or more.

In case of equivalent duration, at least 01 year (full 12 months) of holding the professional title of class II heritage officer by the expiration of the deadline for submitting the application for registration for competition or consideration for promotion;

- During the time of holding the professional title of class II heritage officer or equivalent:

+ Having presided over the research and development of at least 02 scientific research topics, schemes, projects or programs at ministerial or branch level in the field of protection and promotion of cultural heritage values ​​already approved by competent authorities. acceptance and approval; or

+ Has presided over at least 02 national and international collections, archaeological excavations and exhibitions.

Circular 16/2021/TT-BVHTTDL takes effect from February 5, 2022.
