The Law Clerk would like to introduce to customers the following outstanding new policies effective from mid-February 2022 (February 11 - 20, 2022):

1. Periodic time limit for changing jobs with civil servants and public employees in the education sector

This is a remarkable content in Circular 41/2021/TT-BGDĐT stipulating the list and period of periodic change of working positions in agencies, organizations and units under the Ministry of Education and Training and under the Ministry of Education and Training. The scope of management by industry, education field at local government, officially takes effect from February 14, 2022.

Accordingly, the time limit for periodically changing jobs with education civil servants who do not hold leadership positions, managers and education officials is as follows:

- The period of periodical change of working position is from full 03 years to 05 years (excluding the probationary period of civil servants and public employees).

(Currently, the time limit for periodically changing working positions for civil servants and education officials is 05 years (60 months)).

The time to calculate the time limit for changing working positions is the time when the competent authorities' documents on mobilization, arrangement and assignment of tasks are issued according to the provisions of law.

- Units promulgate a list of working positions subject to periodic conversion based on the above provisions to determine the period of periodic change for each specific working position.

Thus, from February 14, 2022, the period for periodically changing jobs with education officials and public employees is from full 3 years to 5 years (excluding the probationary period of civil servants and public employees). instead of full 5 years as current regulations.

2. School transfer documents for middle and high school students from February 15, 2022

Circular 50/2021/TT-BGDĐT amending and supplementing a number of articles of the Regulation on school transfer and admission of students at junior high and high schools, effective from February 15, 2022.

Accordingly, from February 15, 2022, school transfer records for middle and high school students include:

- A transfer application form signed by a parent or guardian.

- Academic transcript (original).

- Certificate of enrollment in the first class of upper secondary school specifying the type of school to be recruited (public or private).

- Letter of recommendation for school transfer issued by the principal of the school where you are going.

- Letter of recommendation for school transfer issued by the Head of Education and Training Department (for junior high school); The director of the Department of Education and Training (for upper secondary schools) of the place of departure (in case of applying for a transfer from another province or city).

Compared to the current one, the following documents have been removed from the application for transferring schools for junior high and high school students:

- Diploma of lower education (notarized copy).

- Copy of birth certificate.

- Valid papers to enjoy the priority regime, encouragement in study, entrance exam, graduation exam (if any).

- Household registration or certificate of long-term temporary residence or decision to transfer work of the parent or guardian at the place to be moved to the students who move from another province or city.

- Certificate from the local government where the student resides with students with particularly difficult family circumstances.

3. New points on conditions and criteria for recognition of war invalids

This is a prominent content in  Decree 131/2021/ND-CP  guiding the  Ordinance on Incentives for people with meritorious services to the revolution , effective from February 15, 2022.

Accordingly, the conditions and criteria for recognition of war invalids and beneficiaries of policies as war invalids (collectively referred to as war invalids) specified in Clause 1, Article 23 of  the Ordinance on Incentives for People with meritorious services to the revolution are  as follows:

- Areas occupied by the enemy, areas with hostilities, and areas adjacent to enemy-occupied areas shall be determined according to the provisions of Appendix III  of Decree 131/2021(Compared to the current, additional areas occupied by the enemy).

- Areas of border, sea and islands with extremely difficult conditions are areas with dangerous, harsh and difficult natural conditions, prone to accidents, including areas specified in Appendix IV  of Decree No. decree 131/2021(Compared with the current, additional border areas, sea and islands).

- Directly serving combat is performing tasks while the battle is going on or when the enemy is bombarding: medics, transports wounded, loads ammunition, ensures communication, protects goods, and ensures told to fight.

Directly performing the task of fighting crime means directly performing tasks at the request of competent agencies to investigate, detect, prevent and arrest criminals or prevent dangerous acts. dangerous to society...

4. Conditions for opening childcare classes at home from February 15, 2022

The Ministry of Education and Training promulgates  Circular 49/2021/TT-BGDĐT  on the Regulation on organization and operation of independent children's groups, independent kindergartens, and independent preschool classes of both private and public types, effective from February 15, 2022.

Accordingly, additional conditions for organizing independent children's groups (homecare classes) from February 15, 2022 are as follows:

- For groups of independent children with a maximum size of 07 children:

+ Each group of children has no more than 01 disabled child. (New content added)

A person who nurtures, cares for and educates children may directly nurture, care for and educate up to 02 children aged from 3 to 12 months old or up to 3 children from 12 to 36 months old.

- With a group of independent children over 07 children, the maximum number of children in a group of children is prescribed as follows:

+ Group of children from 3 to 12 months old: 12 children.

+ Group of children from 13-24 months old: 20 children.

+ Group of children from 25 - 36 months old: 25 children.

Each group of children or kindergarten has no more than 01 children with disabilities learning inclusion. (New content added)
