Notable new policies of Vietnam to be effective as of the start of October 2024

Announcement of amended administrative procedures concerning vehicle inspection under management of Ministry of Transport of Vietnam; contents of consideration and assessment of assurance of conditions for law enforcement; required papers during automobile inspection from October 1, 2024; etc., are notable contents that will be covered in this bulletin.

1. Announcement of amended administrative procedures concerning vehicle inspection under management of Ministry of Transport of Vietnam 

On September 9, 2024, the Ministry of Transport of Vietnam promulgated Decision No. 1117/QD-BGTVT on the announcement of new and amended administrative procedures concerning vehicle inspection under the management of the Ministry of Transport of Vietnam. 

According to the Decision, the list of amended administrative procedures includes 1 administrative procedure under the jurisdiction of central authorities: issuance of and addition to inspection templates; 1 administrative procedure under the jurisdiction of central and local authorities: provision of certificates and seals of technical safety and environmental protection of motor vehicles. 

1 new administrative procedure: provision of certificates and seals of technical safety and environmental protection of motor vehicles in cases where the valid certificates or seals are lost, damaged, torn, or subject to information errors.

2. Contents of consideration and assessment of assurance of conditions for law enforcement in Vietnam

On August 15, 2024, the Minister of Justice of Vietnam promulgated Circular No. 08/2024/TT-BTP elaborating the consideration and assessment of law enforcement. 

According to the Circular, the contents of the consideration and assessment of the assurance of conditions for law enforcement are as follows: 

- The timely, adequate, appropriate, and effective consideration and assessment of the law dissemination shall comply with regulations on the assessment of the effectiveness of law dissemination and education. 

- The timeliness, adequacy, appropriateness, and effectiveness of training for law enforcers shall be considered and assessed based on the following fundamental contents: 

+ The organization of the training complies with the time prescribed in plans approved by competent authorities; 

+ Contents of the training comply with plans approved by competent authorities; 

+ The number of people adequately trained complies with plans approved by competent authorities.

- The appropriateness of the organizational apparatus and the satisfactory level of personnel sources for law enforcement shall be considered and assessed based on the following fundamental contents:  

+ The organizational structure of agencies and units conforms with documents or schemes approved by competent authorities; 

+ The number of actual workers is sufficient compared to the assigned payroll target; 

+ Workers comply with job position standards as per regulation. 

- The satisfactory level of funding and physical facilities for the assurance of law enforcement shall be considered and assessed based on the following fundamental contents: 

+ The actual funding provided for law enforcement of agencies and units in comparison with implementation plans or requirements of tasks; 

+ The actual physical facilities for law enforcement of agencies and units in comparison with implementation plans or requirements of tasks.

3. Required papers during automobile inspection in Vietnam from October 1, 2024 

On August 12, 2024, the Minister of Transport of Vietnam promulgated Circular No. 30/2024/TT-BGTVT on amendments to Circular No. 16/2021/TT-BGTVT on technical and environmental safety inspections applicable to road motor vehicles and Circular No. 03/2018/TT-BGTVT on technical and environmental safety inspections applicable to imported automobiles subject to regulated entities of Decree No. 116/2017/ND-CP.

According to the Circular, vehicle users shall declare and provide the following information and documents to prepare vehicle dossiers (excluding cases of first-time inspection for grant of Inspection Certificates and Inspection Seals with a period of validity of 15 days):

- Documents on vehicle registration: master copy of the vehicle registration certificate issued by a competent state authority or master copy of the notice of receipt of the master copy of the vehicle registration certificate (enclosed with copies of the vehicle registration certificate) of a credit institution or copies of the vehicle registration certificate verified by a financial leasing company according to the law or the appointment letter for grant of the vehicle registration certificate;

- Copies of record of factory release quality inspection for motor vehicles manufactured and assembled domestically (excluding liquidated motor vehicles); 

- Master copies of certificates of technical safety quality and environmental protection for renovated motor vehicles or certificates of technical and environmental safety for renovated motor vehicles in case of newly renovated vehicles;

- Pencil tracings of vehicle identification numbers in case of vehicles eligible for exemption from inspection as prescribed in Clause 3 Article 5 of Circular No. 16/2021/TT-BGTVT;

- Corresponding information as prescribed in Appendix I promulgated together with Circular No. 30/2024/TT-BGTVT.

4. Vietnam’s criteria for selection of herbal ingredients for inclusion in list of toxic medicinal ingredients

On August 26, 2024, the Minister of Health of Vietnam promulgated Circular No. 13/2024/TT-BYT on the list of toxic medicinal ingredients.

According to the Circular, herbal ingredients shall be considered for selection and inclusion in the list of toxic medicinal ingredients when they meet one of the following criteria: 

- Herbal ingredients included in specific treatises in Vietnam Pharmacopoeia or any global pharmacopeia, described as toxic or extremely toxic herbal ingredients (excluding cases where the description says “less toxic");

- Extremely toxic herbal ingredients that affect the health and life of users; 

- Herbal ingredients, when used, cause serious adverse reactions known or recommended by the World Health Organization, Vietnamese competent authorities, or foreign competent authorities.
